CITY OF LOUISVILLE <br /> BUILDING CODE OF APPEALS <br /> Minutes May 20, 1998 <br /> Board Members Present: Giles Schurman <br /> Greg Cullison <br /> Ray Schlott <br /> Robert Spencer <br /> Charles Keim <br /> Staff: Tom Talboom,Board Secretary <br /> Sam Light, City Attorney <br /> 1 Call to Order/Roll Call. The meeting was called to order at 7.07 p.m. All members were <br /> present with the exception of Erik Hartronft. <br /> Note There were no minutes from the last Board meeting as we did not have a quorum <br /> and did not have a meeting. <br /> 2. General discussion International Plumbing Code: <br /> Tom Talboom—I have asked the City Attorney to give us a little overview with regard to <br /> the adoption of the International Plumbing Code. After the meeting I will give the Board <br /> a list of all of the Jurisdictions which have adopted the International Plumbing Code. <br /> Sam Light—Most of the municipalities which have adopted the International Code are <br /> Home Rule. There are two municipalities, Carboale and Fort Lupton,which are the <br /> same type of City as Louisville,which is a statutory City <br /> The difference is that Home Rule municipalities, in matters of local concern, have the <br /> same authority as the State Legislature, or plenary authority Therefore the Home Rule <br /> municipalities have taken the position that in the area of Plumbing, and how Plumbmg <br /> installations are performed in their municipality is purely a local matter Therefore they <br /> have authority, directly from the State Constitution,to regulate plumbing. <br /> With Louisville,we have to look at the State Statutes and see what our authority is m this <br /> area. These would be the statutes that deal with the State Plumbing Board, as well as the <br /> State Plumbing Code. The language here is not as clear as it is in other areas of the <br /> Statutes. Usually when that State Legislature intends to make a law uniform throughout <br /> the State, and intends to take away the power of local governments, it will state within the <br /> 1 <br />
