There was some information in your packets from Jefferson County as to how they are
handling the adoption of the IPC They went through section by section and did a set of
amendments which they believe would be needed to make their code at least as restnctive
as the State code.
Tom Talboom—As of last month they have not yet adopted the code. What I intend to do
is to contact all the jurisdictions and fmd out if they are going to adopt the code out nght,
or if they are doing something similar to Jefferson County
Giles Schurman—Is it the Umons, Organizations, or individuals which are suing the
different municipalities?
Tom Talboom—There was a lawsuit that occurred in 1994 in Summit County where the
Building Official approved Studor vents. That is still going through the appeals process.
That is a good indication of how murky this is. Weld County just adopted the IPC a
couple of weeks ago Steve Peirce was there representing the State Plumbing Board and
hinted that they may sue. We had some Union Plumbers show up at are last hearing. I
think that is a good indication as to what is going to happen at our hearings. I would like
to get to the point where we have one family of international codes.
Sam Light—I do have information as to how Carbon Dale did their adoption. They
basically pickup the International Code wholesale with just a few adjustments to the fees
and one or two of the substantial provisions. I do not know if that was a result of a study
of the two codes or not.
Tom Talboom—I will work on getting the information with regard to how the different
jurisdictions have adopted the code
One of the main reasons we put off adopting the code is that we were hoping that house
bill 1145 would have passed. That would have stated that individual jurisdiction could
adopt an equivalent code. One of the main parts of that bill was that local jurisdictions
could hear appeals of alternate methods and materials. If anyone would like some
information I have some sheets about the bill.
The Unions were able to prevent the bill from passing. We are hoping to resurrect it for
next year Since it did not pass we now need to decide if we are going to pursue the
International Code. The International Building Code will be coming out in the year 2000
Giles Schurman—So you want to adopt the International Plumbing Code first?
Tom Talboom—The State just adopted the 1997 UPC. So we are now at a point where
we need to look at what we want to go with, the UPC or the IPC.
3
