General discussion International Plumbing Code:
Tom Talboom—I have asked the City Attorney to give us a little overview with regard to
the adoption of the International Plumbing Code. After the meeting I will give the Board
a list of all of the Jurisdictions which have adopted the International Plumbmg Code.
Sam Light—Most of the mumcipahties which have adopted the International Code are
Home Rule There are two municipalities, Carbon Dale and Fort Lupton, which are the
same type of City as Louisville, which is a statutory City
The difference is that Home Rule municipalities, in matters of local concern, have the
same authority as the State Legislature, or plenary authority Therefore the Home Rule
municipalities have taken the position that in the area of Plumbing, and how Plumbing
installations are performed in their municipality is purely a local matter Therefore they
have authority, directly from the State Constitution, to regulate plumbing.
With Louisville, we have to look at the State Statutes and see what our authority is in this
area. These would be the statutes that deal with the State Plumbing Board, as well as the
State Plumbing Code The language here is not as clear as it is in other areas of the
Statutes. Usually when that State Legislature intends to make a law uniform throughout
1
