Ray Schlott— 105.2 allows alternate matenals and methods.
Tom Talboom—There needs to be a sentence m there which refer to the Municipal Code on
alternative methods through the Board of Appeals. What I want to do is refer to the Board of
Appeals with is section 15.56 in the Municipal Code. That allows alternate methods and
matenals to be presented to the Board of Appeals.
Ray Schlott—Section 105.2 allows the use of alternate materials. To me that would imply
something that could be done while the job is in progress. Section 105 4 would imply that this
would be something that would be done as an initial design prior to the start of a project. This is
something that I think needs to be considered.
Chuck Keim—Are you suggesting that if there is an alternative design then it needs to come to
this board for approval?
Tom Talboom—Right. That is exactly what this Board is for If they wanted to use an
alternative method of design, or alternative material they would come before the Board.
Giles Schurman—That would be using something which is not specified in the code, new
matenals and design.
Chuck Keim—Isn't the wording m 105 4 a procedure in criteria? What concerns me is we have
deleted the whole thing including 105 4 1 which is the design cntena. Is there a substitute
section in the Municipal Code which covers all these sections?
Tom Talboom—That is in the Municipal Code, which spells out authonty of the Board to hear
appeals of the Building Official. My concern was that this section could be something which is
in conflict with the State.
What I will do is have the City Attorney review this in regards to the Boards procedure's and
make sure that any conflicts will be change accordingly
Ray Schlott—I would recommend that we leave this in.
Giles Schurman—Were Jefferson County and Longmont the only ones which deleted this in its
entirety?
Tom Talboom—Yes. Boulder did amend that section.
Giles Schuman—I think it would be a good idea to have the City Attorney review this section.
Chuck Keim—I would agree. There needs to be a provision like this somewhere. This gives
Tom the ability to approve things, or turn them down, and they do not have to come to the Board
3
