LOUISVILLE BUILDING CODES BOARD OF APPEALS <br /> PUBLIC HEARING <br /> LOUISVILLE PUBLIC LIBRARY <br /> APRIL 17, 1997 <br /> CASE NO: BA-97-001 <br /> APPLICANT: Westwood Homes of Boulder, Inc. <br /> Thomas Aten <br /> LOCATION: 530 Fairfield Lane <br /> REQUEST: The applicant is seeking relief from the Building Officials decision to not <br /> allow DAP,Below Ground Woodlife preservative treatment on two-inch <br /> dimensional Hem Fir to be used as window well material for basement <br /> windows below grade in a new house. <br /> BACKGROUND <br /> Tom Aten, the owner of Westwood Homes constructed a new home at 530 Fairfield Lane. The <br /> building permit was issued July 24, 1996 And a temporary C 0 was issued on January 16, 1997, <br /> pending the resolution of the matter before the board today concerning the use of a brushed on <br /> wood preservative for below grade applications. Mr Aten made and installed window wells for <br /> four basement windows out of 2x10 Hem Fir The window wells extend below grade, two are <br /> approximately three feet deep and two are approximately four and one-half feet deep Mr Aten <br /> was notified on several different inspections that the wood material below grade needed to be of a <br /> species with natural resistance to decay or be pressure treated in accordance with the Uniform <br /> Building Code. <br /> Mr Aten informed the inspectors that he coated the Hem Fir completely with a brush on <br /> application by DAP called Below Ground Woodlife wood preservative. He was told that the Chief <br /> Building Official would review the material used under the provisions of UBC section 104.2.8, <br /> "Alternate materials and alternate design and methods of constructions" if he would submit <br /> documentation about the product. <br /> Mr Aten submitted the information that is in your packet to the Chief Building Official for <br /> approval for the application described above. On the March 31, 1997, the Building Official sent <br /> Mr Aten a written letter declining his request for approval of the DAP preservative as acceptable <br /> alternative under the provisions of UBC section 104.2 8, copy included in packet. Mr Aten was <br /> advised of his nght to due process through the appeals process in that letter <br /> Mr Aten submitted a complete application and supporting information on April 2, 1997 The <br /> request was determined to be an acceptable appeal by the Building Official and was forwarded to <br /> ( the Louisville Building Code Board of Appeals and set for public hearing on April 17, 1997 <br />
