By Order dated July 28,..2000,the Court granted the.Louisville Defendants-Motion <br /> for Extension of Time to AnswerPlaintiffs' Complaint,extending until August°8;2Q00,the date for <br /> -the Louisville Defendants to answer or otherwise respond to Plaintiffs' Complaint. <br /> 3 The Plaintiffs in their Complaint challenge City of Louisville Ordinance No. 1316, <br /> Series 1999,adopting theInternational Plumbing Code("IPC").The Plaintiffs-seek.deelaratory and <br /> injunctive relief to have Ordinance No 1316 declared invalid and repealed. <br /> -4 At its August 1,2000,City.Council meeting,the.Louisviile.City Council directed the <br /> City.Attorney to draft for further City Council consideration.an ordinance repealing the IPC as <br /> adopted by the City Such an ordinance,if passed by the City Council,likely would•resolve the claims <br /> raised in.Plairitiffs' Complaint. <br /> 5 A.period of approximately 60-90 days is necessary for the City of Louisville to prepare <br /> and consider such an ordinance. The.Plaintiffs and Louisville Defendants have determined that such <br /> additional timeshould be provided to explore the possibility of resolution of this case without resort <br /> to further litigation. <br /> 6 Therefore,the Plaintiffs and Loui svi lle Defendants agree that it is appropriate that the <br /> Louisville Defendants have an additional.90 days,or until November 6,2000,in which to answer or <br /> otherwise respond to Plaintiffs' Complaint. <br /> 7 Counsel for the Louisvi"e Defendants has exchanges voice messages with counsel for <br /> the above-captioned Rule 19(a)(2.) parties. Counsel for the 1.9(a)(2) parties has stated that such <br /> parties agree to the.90-day extension of time set forth herein. <br /> WHEREFORE,the Plaintiffs an,d Louisville Defendants hereby jointly move this Court for <br /> an Order consistent with this Stipulation and grant the Louisville Defendants an extension of time, <br /> until and including November 6,2000 in which to submit their answer or other responsive pleading <br /> to Plaintiffs' Complaint.
