11: City,/ <br />im Louisville <br />COLORADO • SINCE 1878 <br />CITY COUNCIL COMMUNICATION <br />AGENDA ITEM 5C <br />SUBJECT: <br />APPROVAL OF A SOLE SOURCE AGREEMENT WITH SPRONK <br />WATER ENGINEERS FOR 2019 WATER RIGHTS <br />ADMINISTRATION <br />DATE: FEBRUARY 5, 2018 <br />PRESENTED BY: KURT KOWAR, PUBLIC WORKS DIRECTOR <br />SUMMARY: <br />Staff is recommending entering into a sole source contract with Spronk Water <br />Engineers (Spronk) for water rights consulting service for 2019. <br />Spronk has been providing assistance in the administration of the City's water rights <br />since 2012 and successfully assumed the lead and singular role in 2017. This long <br />term relationship has distinct advantages to City in the operation of a complex water <br />system. Spronk is able to analyze impacts based on their familiarity and thus reduces <br />the amount of their billable time that would be charged by a new firm in understanding <br />the basics of the City system. This allows for greater precision and reserves budget for <br />more demanding evaluations. In addition, the number of potential replacement <br />consulting firms are limited as a result of the conflict of interest and availability <br />associated with this type work. Lastly, the collaboration between Spronk and our Water <br />Attorneys (Hill & Pollock) is a valuable relationship that has allowed for the successful <br />completion, defense and protection of many of the City's water rights and system. <br />At the end of 2018, staff participated in a joint comparison of water engineering fees of <br />surrounding communities highlighted in the following table below: <br />Community <br />Loveland <br />LouisvillF <br />Engineer Principal <br />Hourly Rates Hourly Rates <br />$100 $195 <br />$105 $200 <br />South Adams <br />$120 $170 <br />Boulder $123 <br />$215 <br />Aurora <br />Westminster <br />Thornton <br />$145 <br />$300 <br />$159 $173 <br />$167 $255 <br />Staff is recommending that Spronk continue to provide guidance, strategy, and <br />management of drought, flood, and day-to-day operations. <br />Water Rights Administration is a routine yearly contract within approved budgets and <br />therefore was not discussed at Utility Committee. <br />CITY COUNCIL COMMUNICATION <br />
