COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS <br /> NOT ON THE AGENDA <br />Davidson thanked the citizens of Louisville for supporting the Louiseville/Superior IGA at the polls. <br /> <br />Mayer welcomed audience members Tim Hedahl and his son Eric and Eric's friend Ben Nelson who <br />were attending for their Civic's Merit Badges for Scouts. <br /> <br />Lathrop extended his appreciation to the Public Works crew for their great work during the recent <br />snow storm. He stated that it was an excellent example of how it should be done. <br /> <br />Keany thanked the citizens for their support in the election. He looked forward to serving the citizens <br />of Louisville for four more years. <br /> <br />REGULAR BUSINESS <br /> <br />RESOLUTION NO. 46, SERIES 1997 APPROVING AN AMENDMENT TO AN <br />ANNEXATION AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF <br />LOUISVILLE, COLORADO <br /> <br />Bill Simmons, City Administrator, addressed his comments to Resolution No. 46, Series 1997, and <br />Ordinance No. 1268, Series 1997, both of which apply to the deannexation of the 80.1 acres on the <br />south side of U.S. 36. The property was annexed in 1986 and this amendment to the annexation <br />agreement would release the City of Louisville from any of the provisions in the annexation <br />agreement. Upon the effective date of the disconnection of the property from the City, the rights and <br />obligations of the City under that agreement would terminate. Any thing of value that the City or <br />owners have received are not required to be returned, including water rights or land previously <br />conveyed to the City. Ordinance No. 1268 is an application to approve the disconnection of the 80.1 <br />acres, second reading. The applicants requested that one of two actions be taken at this point: 1) <br />Withdraw the application to disconnect or 2) in lieu of withdrawing the application to disconnect, the <br />City defer any action on the ordinance to disconnect until the applicants had reached an annexation <br />agreement with the Town of Superior. <br /> <br />Davidson called for any questions, discussion, or motions on Resolution No. 46. <br /> <br />Sisk moved that Council approve Resolution No. 46, Series 1997, seconded by Mayer. Roll call was <br />taken. Motion passed by a 5 - 0 vote with Howard and Levihn being absent. <br /> <br />ORDINANCE NO. 1268, SERIES 1997 - APPROVING THE DISCONNECTION OF <br />CERTAIN REAL PROPERTY FROM THE CITY OF LOUISVILLE, COLORADO - 2ND <br />READING - PUBLIC HEARING (PUBL.
