CTC

(1)

ORDINANCE NO. 1269, SERIES 1997 - AMENDING ORDINANCE NO. 501,
SERIES 1997, REMOVING A GEOLOGIC HAZARD AREA - LOT 1,
OUTLOT A, BLOCK 8 CTC - NE CORNER OF CHERRY STREET &
PIERCE STREET - 2ND READING - PUBLIC HEARING (PUBL. LSVL.
TIMES 10/8/97)

Tanoue read by title only Ordinance No. 1269, Series 1997, "An ordinance amending Ordinance No.
501, Series 1976, to eliminate the geologic hazard area designation for Outlot A of Lot 1, Block 8,
Colorado Technological Center Filing No. 1 ."

Sisk asked to be excused on this as his law partner has a financial interest with Mr. Alu.

Davidson excused Sisk.

Paul Wood, Planning Director, stated that this is in conjunction with property located at 1500 Cherry
Street, at the northeast corner of Cherry Street and Pierce Street. Outlot A is approximately one
acre, created as a no-build zone in conjunction with this geologic hazard area. The applicant
requested by this ordinance that the geologic hazard area be removed. The property owner had a
letter from the State Geological Society indicating that there were no mine shafts ever associated with
Outlot A. By Municipal Code the evidence needed to be clear to Council in order to remove a
geologic hazard area. Staff, via phone, had further conversations with the State geologist. Their
conclusion was based upon historic mapping of the area and they were confident that there are no
mine shafts ever associated with this property.

Davidson opened the public hearing and called for anyone wishing to speak on this ordinance.

NONE

Davidson closed the public hearing and called for Council comments, questions, or motions.

Mayer moved that Council approve Ordinance No. 1269, Series 1997, subject to confirmation of the
evidence of no geological hazard, seconded Keany.

Lathrop felt the letter confirming that there was no geologic hazard on the property from the State
Geologic Society was sufficient confirmation.

Mayer removed his amendment from his motion. Seconder Keany agreed. Roll call was taken.
Motion passed by a 4 - 0 vote with Sisk being excused and Howard and Levihn being absent.

(2)

RESOLUTION NO. 47, SERIES 1997 - FINAL PUD DEVELOPMENT PLAN -
LOT 1, BLOCK 8, CTC - BACHLIB
