CTC <br /> <br />(1) <br /> <br />ORDINANCE NO. 1269, SERIES 1997 - AMENDING ORDINANCE NO. 501, <br />SERIES 1997, REMOVING A GEOLOGIC HAZARD AREA - LOT 1, <br />OUTLOT A, BLOCK 8 CTC - NE CORNER OF CHERRY STREET & <br />PIERCE STREET - 2ND READING - PUBLIC HEARING (PUBL. LSVL. <br />TIMES 10/8/97) <br /> <br />Tanoue read by title only Ordinance No. 1269, Series 1997, "An ordinance amending Ordinance No. <br />501, Series 1976, to eliminate the geologic hazard area designation for Outlot A of Lot 1, Block 8, <br />Colorado Technological Center Filing No. 1 ." <br /> <br />Sisk asked to be excused on this as his law partner has a financial interest with Mr. Alu. <br /> <br />Davidson excused Sisk. <br /> <br />Paul Wood, Planning Director, stated that this is in conjunction with property located at 1500 Cherry <br />Street, at the northeast corner of Cherry Street and Pierce Street. Outlot A is approximately one <br />acre, created as a no-build zone in conjunction with this geologic hazard area. The applicant <br />requested by this ordinance that the geologic hazard area be removed. The property owner had a <br />letter from the State Geological Society indicating that there were no mine shafts ever associated with <br />Outlot A. By Municipal Code the evidence needed to be clear to Council in order to remove a <br />geologic hazard area. Staff, via phone, had further conversations with the State geologist. Their <br />conclusion was based upon historic mapping of the area and they were confident that there are no <br />mine shafts ever associated with this property. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on this ordinance. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments, questions, or motions. <br /> <br />Mayer moved that Council approve Ordinance No. 1269, Series 1997, subject to confirmation of the <br />evidence of no geological hazard, seconded Keany. <br /> <br />Lathrop felt the letter confirming that there was no geologic hazard on the property from the State <br />Geologic Society was sufficient confirmation. <br /> <br />Mayer removed his amendment from his motion. Seconder Keany agreed.
