B. For temporary suspension or permanent revocation of a license or <br />registration, the City shall have the burden to show, by a preponderance of evidence, <br />that the licensee committed one or more acts prohibited by the building code. The City <br />may be represented by the Building Official or his or her designee. <br />Section 9. Order of Hearings. The order of the hearing shall be as follows <br />unless revised by the Board by vote at the hearing: <br />A. Chair opens public hearing, announces the subject matter of the hearing, <br />and described the procedure for conducting the hearing. <br />B. Determination of compliance with public notice requirements. <br />C. Board member disclosures, if any, including conflicts of interest, ex parte <br />(outside the hearing) contacts or other matter. <br />D. Conduct of the appeals hearing, to include, without limitation: <br />I. Presentation by the appellant; <br />ii. Presentation by City staff; <br />iii. Testimony by persons in attendance; <br />iv. Board questions of appellant or staff; and <br />v. Closing statements. <br />E. Conduct of the suspension or revocation hearing, to include, without <br />limitation: <br />i. Presentation by City staff; <br />ii. Presentation by the licensee; <br />iii. Testimony by persons in attendance; <br />iv. Board questions of licensee or staff; and <br />v. Closing statements. <br />F. Close the public hearing. <br />G. Board comment and decision on merits or to take the matter under <br />advisement. <br />151 Page <br />
