City Council Finance Committee <br />Meeting Minutes <br />05/17/19 <br />Page 3 of 6 <br />STAFF REPORTS/UPDATES/DISCUSSIONS <br />Transfer of Recreation Impact Fee Balance <br />Finance Director Kevin Watson requested guidance from the Finance Committee <br />concerning the transfer of the Recreation Impact Fee balance ($240K). Director <br />Watson stated that these funds are highly restricted and must be used for the <br />expansion of capital facilities, and spent within six years. <br />Finance Committee Members and staff discussed various projects and uses, but <br />decided to revisit the transfer at a Fall Finance Committee meeting. <br />Feedback from Meeting with Police Department and Municipal Court regarding <br />Delinquent Sales Tax Enforcement <br />Finance Director Kevin Watson stated that he and Tax Department staff met with <br />representatives of the Municipal Court and Police Department to discuss the <br />process of citing violations of the Sales & Use Tax Code into Municipal Court, and <br />the collection process. <br />Director Watson informed the Finance Committee that the Prosecuting Attorney <br />did not want large delinquencies referred to the Municipal Court due to <br />jurisdictional issues, and that the County Courts may be better suited for these <br />cases. <br />City Attorney Kathleen Kelly stated that she would speak to the Prosecuting <br />Attorney to identify the jurisdictional issues she is concerned about. <br />Director Watson stated that if larger cases cannot be referred to the Municipal <br />Court, the only remaining Municipal Code option is business seizure, and <br />requested guidance from the Finance Committee Members. <br />Mayor Muckle stated that he does not want the City to shut down any local <br />businesses. Finance Committee Member Lipton stated that the City should give <br />businesses an opportunity to reorganize and give them as much time as we can, <br />even if that risks seizure by the State. Chairperson Maloney stated that there has <br />to be a cost -benefit analysis, but so long as a business remains open, the City <br />should allow them time to pay. <br />RECREATION CENTER DASHBOARD <br />Director of Parks & Recreation Nathan Moseley presented a new Recreation <br />Center Dashboard for 1st Quarter 2019 to the Finance Committee. Director <br />Moseley stated that Nat Ahrens, IT Business Data Analyst helped with the new <br />format and gathering the data. <br />4 <br />
