RESOLUTION NO. 07 <br />SERIES 2017 <br />A RESOLUTION RECOMMENDING APPROVAL OF A PLANNED UNIT <br />DEVELOPMENT (PUD) AMENDMENT AND SPECIAL REVIEW USE (SRU) <br />AMENDMENT TO ALLOW FOR A MODIFICATION OF INTERIOR AND EXTERIOR <br />SPACES <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for approval of a Planned Unit Development (PUD) amendment and Special <br />Review Use (SRU) amendment to allow for modifications of the interior and exterior <br />spaces at 817 Main Street at S 5ft Lot 10 & N 20ft Lot 11, Block 5, Louisville Old Town. <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with Louisville Municipal Code Sec. 17.28.170; and <br />WHEREAS, the City Staff has reviewed the SRU application and found it to <br />comply with Louisville zoning regulations, the special review use criteria as set forth in <br />Section 17.40.100 of the Louisville Municipal Code, and other applicable requirements; <br />and <br />WHEREAS, after a duly noticed public hearing on February 9, 2017, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Reports dated February 9, 2017 the Planning <br />Commission finds the Planned Unit Development (PUD) amendment and Special <br />Review Use (SRU) amendment to allow for the modification of interior and exterior <br />spaces at 817 Main Street shall be approved with conditions. <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br />Louisville, Colorado does hereby recommend approval a Planned Unit Development <br />(PUD) amendment and Special Review Use (SRU) amendment to allow for <br />modifications of the interior and exterior spaces at 817 Main Street with the following <br />conditions: <br />1. Prior to issuance of the building permit, the applicant shall enter into an <br />agreement with the City to address safety and maintenance of the staircase <br />within the public right-of-way. <br />2. Prior to certificate of occupancy, the applicant shall comply with all requirements <br />of the amended conservation easement, including the interpretive signage. <br />3. Prior to the City Council hearing, the applicant shall amend the plan to include <br />the following notes: <br />A. Nighttime hours of operation for the outdoor patio shall not extend past 12 <br />am. <br />B. Patio lighting shall be down -cast lighting with full cutoff fixtures with a <br />maximum Tight level of 1,500 lumens per light. <br />C. There will be no dancing or live music permitted in the open deck area. <br />D. The businesses shall provide sidewalk dining in the appropriate seasons to <br />maintain street level pedestrian activities. <br />
