RESOLUTION NO. 53, <br />SERIES 2008 <br />A RESOLUTION APPROVING THE PARBOIS PLACE PRELIMINARY <br />SUBDIVISION PLAT AND A PRELIMINARY PLANNED UNIT DEVELOPMENT <br />(PUD) PLAN TO ALLOW FOR THE DEVELOPMENT OF APPROXIMATELY ONE <br />(1) ACRE IN AREA <br />WHEREAS, there has been submitted to the Louisville City Council a <br />request for a preliminary subdivision plat and a preliminary planned unit <br />development (PUD) plan to allow for the development of approximately one (1) <br />acre in area; and <br />WHEREAS, the Planning Commission held public hearings on the <br />application on July 10, 2008, August 14, 2008, and October 9, 2008 where <br />evidence and testimony was entered into the record, including the application <br />materials and Staff Reports dated July 10, 2008, August 14, 2008, and October 9, <br />2008; and <br />WHEREAS, City Council reviewed the application relative to the <br />requirements of Chapter 17 of the Louisville Municipal Code (LMC) and other the <br />applicable design standards and guidelines in the Old Town Overlay Zone District <br />and found the application should be approved with the following conditions: <br />1. The Subdivider to fully comply with a public use dedication as set forth in <br />Section 16.16.060 of the Louisville Subdivision Code with an agreement <br />resolving the land dedication issue to be in place at final platting. <br />2. The PUD shall be modified to reduce the number of proposed dwelling <br />units from 16 to 15 units to be consistent with the underlying zoning <br />requirements for the entire site. <br />3. The subdivision plat shall be revised to reflect the alley right-of--way <br />dedication by outlot. The conveyance of the right-of--way shall establish a <br />minimum alley width of 20' for the full length of the property backing up to <br />the alley. <br />4. In accordance with the provisions of the Floodplain Development Permit, <br />the lowest habitable floor elevation shall be certified at an elevation of <br />5,332. Elevation certificates :shall be submitted for each dwelling unit prior <br />to the issuance of a certificate of occupancy. <br />5. The applicant shall coordinate with the City Forester to establish a minimum <br />setback around the existing Silver Maple Tree and incorporate that <br />requirement on the final PUD landscape plan. <br />
