RESOLUTION NO. 62 <br />SERIES 2008 <br />A RESOLUTION AUTHORIZING THE INDEMNITY OF POLICE CHIEF <br />BRUCE GOODMAN, FORMER DEPUTY CITY MANAGER JULIE <br />BOYD, AND FORMER CITY MANAGER WILLIAM A. SIMMONS FOR <br />ANY JUDGMENT ENTERED AGAINST THEM IN THEIR INDIVIDUAL <br />CAPACITIES PURSUANT TO 42 U.S.C. § 1983 IN THE LAWSUIT FILED <br />IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF <br />COLORADO, CIVIL ACTION N0.06-CV-02261-WYD-MJW <br />WHEREAS, Police Chief Bruce Goodman, Former Deputy City Manager Julie Boyd <br />and Former City Manager William A. Simmons, have been sued in their individual capacities in <br />a lawsuit captioned Jerry V. Riggins v. City of Louisville, Louisville Police Department, Bruce <br />Goodman, Julie Boyd, and William A Simmons, United States District Court for the District of <br />Colorado, Civil Action No. 06-cv-02261-`'VYD-MJW; and <br />WHEREAS, the City's consideration of the events involved in this lawsuit based upon <br />the evidence available to the City at this time show that these employees were acting in good <br />faith and in the course and scope of their duties as City employees and in compliance with City <br />policy at the time of the allegations asserted against them by Jerry Riggins in the Amended <br />Complaint filed in the above-referenced lawsuit; and <br />WHEREAS, the City has already agreed to provide a defense to these three defendants <br />named in their individual capacities for thf; procedural due process claim asserted against them in <br />the above-referenced lawsuit pursuant to 42 U.S.C. § 1983; and <br />WHEREAS, based upon all information and evidence available to the City at this time, it <br />is in the public interest as well as in the interest of Police Chief Goodman, and former employees <br />Julie Boyd and William Simmons, for the City Council to officially state its support for them by <br />not only providing the with a defense to t:he claim against them, but also agreeing to indemnify <br />them from any judgment entered against them in their individual capacities as a result of the <br />procedural due process claim asserted against them pursuant to 42 U.S.C. § 1983 in the above- <br />referenced lawsuit; <br />NOW, THEREFORE, BE IT KESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />That the City Council, based upon all evidence and information available to it at this <br />time, hereby agrees to indemnify Police Chief Bruce Goodman, Former Deputy City Manager <br />Julie Boyd and Former City Manager William Simmons from any judgment entered against them <br />in their individual capacities pursuant to 42 U.S.C. § 1983 for the alleged violation of Jerry <br />Riggins procedural due process rights in the lawsuit entitled Jerry V. Riggins v. City of <br />Louisville, Louisville Police Department, Bruce Goodman, Julie Boyd, and William A Simmons, <br />United States District Court for the District of Colorado, Civil Action No. 06-cv-02261-WYD- <br />MJW. <br />
