RESOLUTION NO. 16 <br />SERIES 2019 <br />A RESOLUTION RECOMMENDING APPROVAL OF AN ORDINANCE AMENDING <br />CHAPTER 17.68 OF THE LOUISVILLE MUNICIPAL CODE TO REQUIRE OIL AND <br />GAS OPERATOR REGISTRATION <br />WHEREAS, the City's oil and gas regulations were last updated in 1996 and <br />there are currently no oil or gas operations being conducted within the City; and <br />WHEREAS, on April 16, 2019, the Govemor signed Senate Bill 19-181 ("SB 181"), <br />which amended the Colorado Oil and Gas Conservation Act and granted local <br />governments more authority to regulate surface operations and nuisance impacts of oil <br />and gas operations in order to better protect the health, safety, and welfare of its citizens <br />and to safeguard the environment and natural resources; and <br />WHEREAS, the Planning Commission desires to adopt requirements for Oil and <br />Gas Operator Registration; and <br />WHEREAS, the Planning Commission has considered the application at a duly <br />noticed public hearing on September 12, 2019, where evidence and testimony were <br />entered into the record, including the findings in the Louisville Planning Commission <br />Staff Report dated September 12, 2019. <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br />Louisville, Colorado does hereby recommend approval of a request to amend Chapter <br />17.68 of the Louisville Municipal Code to require Oil and Gas Operator Registration. <br />PASSED AND ADOPTED this 12th day of September, 2019. <br />By: <br />Attest: <br />'Debra Williams, Secretary <br />Planning Commission <br />' <br />Steve Brauneis, Chairperson <br />Planning Commission <br />
