POLICE DEPARTMENT'S REPORT <br /> <br />A. Police Reports for Gentleman Jim's. <br /> <br />Sergeant Riggins reported on a police investigation that multiple persons were served while intoxicated <br />at Gentleman Jim's. One party was arrested for DUI, another party was put on an alcohol recovery hold. <br />After conclusion of the investigation, the owner and the bartender were served with municipal summons <br />charging each with serving intoxicated and underaged persons. Sergeant Riggins also noted that the <br />bartender is employed by Gentleman Jim's as a cook. At the time of the incident, he was working part- <br />time as a bartender. The Authority asked that the records be reviewed to establish whether the bartender <br />had attended or completed a training session offered through the City. <br /> <br />Sergeant Riggins stated that it was the Police Department's position that the Authority would consider a <br />Show Cause Hearing to examine the facts of said violations at the establishment of Gentleman Jim's. He <br />noted that this establishment has had other violations. <br /> <br />After lengthy discussion as to the alleged violations, Attorney Light clarified that the Authority could <br />look at all of the charges as potential liquor license violation under the State Code and Municipal Code <br />and order a Show Cause Hearing. The appropriate notices and hearing procedures would have to be <br />followed, and a Special Prosecutor would have to be appointed to represent the City. Attorney Light <br />would draft the order, if the Authority so desired. The regulation at issue is 47-900 and there is an <br />addition to that in the statutory section 12-47-901 (5)(A). <br /> <br />Jeffers moved the Authority issue a notice of Show Cause Hearing, for James Hayden, d/b/a/Gentleman <br />Jim's, Inc., on Monday, March 9, 1998 at 7:00 p.m., on three counts of Selling to Persons Prohibited, for <br />visibly and/or apparently intoxicated, one count of Selling to Persons Prohibited Underage and that notice <br />be served, and that Attorney Steve Barnett, be appointed to represent the City to prosecute this case. <br />Motion was seconded by Lipton. All in favor. Motion passed <br /> <br />SECRETARY'S REPORT <br /> <br />No report <br /> <br />AUTHORITY ATTORNEY'S REPORT <br /> <br />A. Firegrill - Inactive License <br /> <br />Attorney Light reported that the Firegrill currently has a liquor license which does not expire until <br />October 9, 1998. With inactive licenses, the Authority has two options: 1 .) Determine if construction <br />commences within one year after approval, if not the board may revoke or elect not to renew. 2.) If the <br />property has not been constructed and fails to operate within two years, the board may elect to revoke or <br />not renew the license.
