Morris moved that the 1997 Annual Report, as amended, be approved. Seconded by Evans. All in favor. <br />Motion carried. <br /> <br />POLICE DEPARTMENT REPORT No Report <br /> <br />Sergeant Riggins did have questions relative to Henry's with regard to the stipulation agreement. His <br />questions was, with respect to the voluntary hours of closure, whether that was a binding agreement. <br /> <br />Chairman Jeffers noted that with regards to the stipulation, Henry and his lawyer were going to make <br />changes, in terms of personnel, menu, hours, and close early, but they were not going to amend his <br />license to reflect new hours of operation. This was a good faith effort entirely on his part. <br /> <br />Sergeant Riggins noted that Pine Street Junction is advertising outside entertainment, on the premises. <br />The Authority can monitor this situation and if a complaint is brought, review the case at the time, or <br />review this at the time of renewal, by removing it from the consent agenda and setting it for a hearing. <br /> <br />SECRETARY'S REPORT <br /> <br />An updated phone list, which also included members terms, was distributed. Revision and additions were <br />made and a new list will be circulated at the next meeting. <br /> <br />AUTHORITY ATTORNEY'S REPORT <br /> <br />Attorney Light report on Senate Bill 98-037, which was proposed by Senator Lacy. it's original form, <br />this bill had proposed to put restrictions on the ability of Local Licensing Authorities to take disciplinary <br />action with regard to violations for serving persons under 21 years of age. This bill has been significantly <br />amended to remove the actual restrictions on licensing authority to impose certain penalties, however, the <br />current form of the bill now states that the Department of Revenue will, as part of its rules, promulgate a <br />range of penalties for use of Licensing Authorities, to be considered when persons of under 21 years of <br />age, are used to investigate sales and alcohol beverages. <br /> <br />AUTHORITY COMMENTS <br /> <br />Cheng's Garden may be planning an addition on to their establishment. The Secretary was requested to <br />check with the Planning and Building Departments to verify this information.
