11: City,/ <br />im Louisville <br />COLORADO • SINCE 1878 <br />CITY COUNCIL COMMUNICATION <br />AGENDA ITEM 2 <br />SUBJECT: <br />DISCUSSION/DIRECTION — WATER TAP FEE CALCULATION <br />AND APPROVAL PROCESS <br />DATE: NOVEMBER 25, 2019 <br />PRESENTED BY: HEATHER BALSER, CITY MANAGER <br />KURT KOWAR, PUBLIC WORKS DIRECTOR <br />SUMMARY: <br />At the November 4, 2019 City Council meeting Council requested additional information <br />about the establishment of City water tap fees. Attached is a presentation with more <br />background on the City's water sources, planning efforts, tap fee methodology and how <br />it was developed, and surrounding community tap fee rates. In addition, staff has <br />provided some options for City Council regarding the proposed increase to tap fees <br />below. <br />Pursuant to Section 13.12.040 of the Louisville Municipal Code, the City Manager has <br />the authority to establish City water tap fees. The ordinance establishing this rule is also <br />attached. <br />Attached is the packet from November 4th, 2019, with the City Council approved <br />Resolution No. 38, Series 2019, Setting Certain Fees, Rates and Charges for 2020. As <br />in past years, staff also provided City Council with the City Manager approved fees, <br />rates and charges for informational purposes so that Council would be aware of all City <br />fee changes for the upcoming year. Among the City Manager approved fees are the <br />City tap fees, which consistent with the City ordinance and policy, are adjusted based <br />on CBT (Colorado Big Thompson) water sale prices. The proposed tap fees were <br />previously discussed and recommended for approval by the Utility Committee and the <br />Finance Committee but due to the significance of the increase based on the current <br />formula, City Council requested further discussion about the process, methodology and <br />other potential options for setting the fees. <br />How Water Tap Fees are Established <br />• Section 13.12.040 of the LMC requires the City Manager to establish a table of <br />City water tap fees annually <br />• Tap fees are computed by reference to the provisions of Chapter 13.12 of the <br />Louisville Municipal Code. <br />• Based on City staff's computation, City Manager establishes the tap fees <br />• Tap fees are set forth in a table of fees <br />CITY COUNCIL COMMUNICATION <br />2 <br />
