<br /> AN ORDINANCE A FRANCHISE BY THE TOWN OF LOUISVILLE TO THE PUBLIC
<br /> SERVICE COMPANY OF COLORADO, ITS SUCCESSORS AND ASSIGNS , TO CONSTRUCT
<br /> ACQUIRE, MAINTAIN AND OPERATE A RANT OR PLANTS , AND WORKS , FOR THE
<br /> GENERATION, TRANSMISSION- AND DISTRIBUTION OF ELECTRICITY AND TO FUR-
<br /> . NISH, SELL AND DISTRIBUTE SAID PRODUCT TO TIIE SAID TOWN OF LOUISVILLE
<br /> AND THE INHABITANTS THEREOF FOR LIGHT, HEAT AND POWER, OR OTHER MEANS
<br /> OF CONDUITS , CABLES , POLES AND WIRES STRUNG THEREON, OR OTHERWISE,
<br /> OVER, UNDER, ALONG, ACROSS AND THROUGH ALL STREETS, ALLEYS AND PUBLIC
<br /> WAYS AND PLACES IN THE TOWN OF LOUISVILLE, AND FIXING THE TERMS AND
<br /> CONDITIONS THEREOF.
<br /> BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF LOUISVILLE
<br /> Section 1. - That the franchise and, right is hereby granted by the Town
<br /> of Louisville (hereinafter called Town) to PUBLIC SERVICE COMPANY OF
<br /> COLORADO (hereinafter called Company) its successors and assigns, to
<br /> locate, build, construct , acquire , extend; maintain and operate into,
<br /> within and through said Town a plant or plants and works for the manu-
<br /> facture, generation, transmission and distribution of electricity for
<br /> illuminating, seating, and power, or other purposes, with the right
<br /> and privilege, for the period and upon the terms and conditions here-
<br /> inafter specified, to furnish, " sell and distribute electricity to the
<br /> Town and the inhabitants thereof by means of substations , conduits,
<br /> cables and lines of poles with wires strung thereon, or otherwise, on,
<br /> over, under, along, across and through any and all streets, alleys
<br /> and public ways_ and places in said Town; and on, over, under, along,
<br /> across and through any and all such new streets,, alleys and public
<br /> ways, and places as may be hereafter laid out, opened, located or
<br /> constructed witk±n the territory now or hereafter included in the
<br /> boundaries of said Town.
<br /> Section 2. The right to use and occupy said streets, alleys, public
<br /> ways and places for the purposes aforesaid shall not be eXc'lusive
<br /> and the Town reserves the right to grant the same or similar use to
<br /> any tithe- during the period of this franchise.
<br /> Section 3. All transmission and distribution structures and equip-
<br /> ment erected by the Company within said Town shall be located so as
<br /> to cause minimum interference with proper use of streets , alleys
<br /> and other public ways and places.
<br /> Section 4. The Company shall so maintain its structures, apparatus
<br /> ' and equipment as to afford all reasonable protection against injury
<br /> or damage to persons or property therefrom; and the Town shall be
<br /> • - saved harmless from any damage' arising out of the exercise by the
<br /> Company of the rights and privileges hereby granted.
<br /> Section 5; The Town shall have the right to the use of any poles
<br /> owned and operated by the Company in said Town for the attachment
<br /> of an electrical fire and police alarm system; provided, however,
<br /> that said Town shall save and hold harmless the Company from any
<br /> damage arising from such use of said poles.
