• <br /> Section ll. The Town may in form and manner as provided by law, upon <br /> payment of just compensation therefor, purchase and take over the pro- <br /> perty and plant of the Company situated in and actually used and use- <br /> ful for the convenience of the Town and its inhabitants. <br /> Section 12. The Company shall not, as to rates, charges , service fac- <br /> ilities , rules, regulations or in any other respect, make or grant any <br /> preference or advantage to any corporation or person or subject any <br /> corporation or person to any prejudice or disadvantage , provided that <br /> nothing in this grant shall be taken to prohibit the establishment , <br /> from time to time, of a graduated scale of charges and classified rate <br /> schedules to which any customer coming within such classification <br /> would be entitled. <br /> Section 13. The right is hereby reserved to the Town to adopt , from <br /> time to time , in addition to the provisions herein contained, such <br /> ordinances as may be deemed necessary in the exercise of its police <br /> power, provided that such regulations shall be reasonable and not <br /> destructive of the rights herein granted, and not in conflict with <br /> the laws of the State of Colorado. <br /> Section 14. Wherever 'Company" is used in this franchise it is in- <br /> tended to include not only Public Service Company of Colorado, but <br /> also its successors and assigns. <br /> Section 15. That, whereas , •said Town and its inhabitants otherwise <br /> will not continue adequately or properly to be supplied with electri- <br /> city, an emergency is declared to exist and this ordinance is de- <br /> clared to be necessary to the immediate preservation of the public <br /> peace , health and safet.;T and shall go into effect immediately upon <br /> its final passage and publication. <br /> Passed, adopted and ordered published this 16th day of March 1930. <br /> ATTEST: G.
