Section 3. That' Rule 20 of Section 6 of said Ordinance No. 128 <br /> is hereby amended to read as follows: <br /> "Rule 20. Whoever' shall by himself) or 'by' any` other'person acting <br /> tinder his authority, 'use' or take water from' any part of the water <br /> Vorks 'aforesaid without a license or permit, or shall, without <br /> authority from said water department, open or hitch to, take out, <br /> curb over or remove any fire plug or hydrant , stop cock valve , <br /> valve box or any other fixtures pertaining to said water works, or <br /> shall tamper with or damage any water meter, or shall let On or <br /> shut off water into or from any water pipe Wherever situated without <br /> authority, license or permit from the Town, shall be deemed guilty <br /> of a misdemeanor, and on conviction therefor shall be fined not <br /> less than five nor more than fifty dollars. <br /> Section 4. Amended by Ordinance No., 192. <br /> Section 7. Amended by Ordinance No. 192. <br /> Section 5. That Section 8 of the said Ordinance No. 128 is hereby <br /> amended to read as follows; <br /> Section 8. °dhenever any person shall have been convicted any second <br /> time of a violation of any one or more of the provisions of this <br /> Ordinance , the Board of Trustees may, regardless of any fine or <br /> other penalty assessed or inflicted against him for such second <br /> violation, order the premises and use of such person metered for <br /> any future use of water on the same premises by such consumer un= <br /> less his water service has been shut off for such violations, in <br /> which case same may be only turned on again on condition that all <br /> charges and penalties be paid and a meter installed if the board so <br /> orders. If ' such service is not of the classification for which <br /> meter rates have been established, then the meter rates to be <br /> applied to such consumer shall be as' provided in Section 7 (a) <br /> hereof until changed by ordinance. " <br /> Section 6. It' is hereby declared that this Ordinance and the pro- <br /> visions thereof is and are necessary for the immediate preservation <br /> of the public peace , health and safety and that it may be in effect <br /> on the first day of January, 1935, for the reason that it is <br /> perative that an increased revenue may be derived from the operation <br /> of the Town water system without increasing the burden borne by <br /> property;' that the financial condition of the Toth has been and will <br /> continue to be materially changed and depressed 'by expenditures <br /> necessitated by work relief projects undertaken and carried on <br /> therein and in and about the Town water system; by drafts upon its <br /> finances for the payment of interest on its bonded indebtedness <br /> created for the improvement of the water system and the necessity <br /> of setting up and providing sinking funds for the ultimate redemp- <br /> tion of such bonded indebtedness'. ' <br /> Section 7_.._ All 'ordinances and parts 'of ordinances in conflict here- <br /> with are 'hereby repealed. <br />
