That the variance, if granted, is the minimum variance that will afford relief and is the <br /> least modification possible of the provisions of Title 17 of the Louisville Municipal Code <br /> that is in question. <br /> The applicant proposes to increase the allowable number of lots from one to two, which requires <br /> variances from the minimum lot width and area requirements. The applicant is proposing a one <br /> lot density increase. Staff finds the request has been minimized and that this criterion has been <br /> met. <br /> PUBLIC COMMENTS: <br /> Staff has not received any comments on this application as of the writing of this report. Notice <br /> was sent to property owners within 500 feet of the subject property. <br /> STAFF RECOMMENDATION: <br /> Staff finds that Criterion#1 and#3 of Section 17.48.100 of the LMC have not been met. <br /> Therefore, Staff is recommending disapproval of two variances from Sections 17.12.040 of the <br /> Louisville Municipal Code: 1) a reduction in the minimum lot size requirement from the RL <br /> zoning district of 7,000 SF—Lot 2 is proposed at 6,300 SF; and 2) a reduction in the minimum <br /> lot width requirement of 70 feet—Lot 1 is proposed at 58' in width and Lot 2 is proposed at 42' <br /> in width. If approved by the Board, the applicant would be required to apply for approval of a <br /> minor subdivision replat,which would be reviewed and acted upon by the Planning Commission <br /> and City Council. <br /> Alternately, staff has discussed the aspects of this request concerning the preservation of existing <br /> site improvements and the scale of homes if constructed on smaller lots. <br /> BOARD ACTION: <br /> The Board may approve (with or without condition or modification), deny or continue the <br /> application to a future meeting for additional consideration. The Board may also request <br /> additional information if they feel that is needed for their proper consideration of the variance <br /> application. The Board needs to find that all six variance criteria, insofar as applicable, have <br /> been met in order to grant approval of a variance. The variances, if granted would be valid for <br /> six (6)months. The applicant would need to submit a complete minor subdivision application in <br /> that six months time frame. <br /> 4 <br />
