<br />City Council <br />Study Session Summary <br />December 9, 2008 <br />Page 2 of 3 <br /> <br />UpdatelDiscussion - State Highway 42 and South Boulder Road Intersection <br />Project <br />David Thompson gave an update on the status of the Highway 42 and South Boulder <br />Road Intersection Project. He noted that the project is ready to go but is waiting on <br />approval from Lafayette and Boulder County for the acquisition of right-of-way from the <br />Harney-Lastoka Open Space for the northbound right hand turn lane. Given that funding <br />from the Denver Regional Council of Governments and the Colorado Department of <br />Transportation (CDOT) is dependant on the project being started no later than <br />September 30, 2009, staff began looking for changes that would no longer require the <br />approval of Lafayette and Boulder County. <br /> <br />Mr. Thompson reported that a new project design has been completed that does not <br />depend on the Harney-Lastoka right-of-way acquisition. This new designs eliminates the <br />dedicated northbound right hand turn lane, reduces the bike lane, and eliminates the <br />sidewalk. However, he noted that these items would all be added back in at a later date <br />to complete the project. This new design has been approved by CDOT and will allow for <br />construction to be underway by September 2009, thus not jeopardizing the funding. <br /> <br />UpdatelDiscussion - Refuse and Single Stream Recyclables Collection Program <br />Mr. Phare reviewed the draft ordinance that would allow the City to establish a trash <br />program with a single hauler. He noted that the ordinance as written does include the <br />collection of fees for trash service through the existing utility bills and does provide the <br />City the option of discontinuing water service if trash fees are not paid in full. This <br />process is typical for those communities providing such programs. Mr. Phare noted <br />however that such a measure would be the last recourse and other arrangements would <br />be used prior to discontinuing utility service. The ordinance does not set fees which <br />would be done by resolution at a later date. <br /> <br />Mr. Phare noted that the ordinance provides exceptions from service to homeowners' <br />associations, multifamily units, and commercial and industrial sites. <br /> <br />Councilor Dalton stated that he doesn't support the ability of the City to shut off water for <br />nonpayment of trash service. <br /> <br />Mayor Sisk asked if the vendor could collect the fees and not the city. Mr. Phare replied <br />it is possible, but stated it may raise the cost to the residents and would have to be <br />negotiated with the contractor as it was not in the original request for proposals. <br /> <br />Councilor Dalton asked if it could be possible to allow residents to opt out of the <br />program. <br /> <br />Councilor Marsella noted that by making exceptions the City will then have more trucks <br />on the streets again and as the numbers of users go down, the costs will go up. <br /> <br />Mr. Phare stated that the final ordinance will come to the City Council on December 16 <br />for first reading and for full deliberation and public hearing on January 6th.
