Local Licensing Authority <br />Minutes <br />April 28, 2008 <br />Page 5 of 8 <br />Officer Muldoon went to the Back Room to talk to Tarene Jacobs, the bartender <br />on duty that evening, about Mr. Watson being in the bar. She indicated to Officer <br />Muldoon she had Mr. Watson's bar tab for the evening and it showed seven <br />drinks purchased. She reported serving four drinks to Mr. Watson and his <br />purchasing the other three for friends. <br />Officer Muldoon testified he issued a summons to the bartender on February 21 <br />for serving persons prohibited based on his observations of the event. Jacobs <br />made a comment to Officer Muldoon she and the owner had viewed the video <br />and Mr. Watson did not seem intoxicated at the time of last service. Officer <br />Muldoon asked to have the owner contact him so he could view the video. <br />Contact was never made, even after subsequent phone calls left with employees <br />of the establishment. <br />Officer Muldoon was asked about the blood/alcohol content test given to Mr. <br />Watson. Muldoon said he would have expected the BAC to be much lower if Mr. <br />Watson had only consumed four beers at the Back Room. <br />Officer Jay Brawner, a patrol officer with the Louisville Police Department was <br />sworn in and testified. Attorney Fredericksmeyerestahlished Officer Brawner's <br />training in alcohol related arrests. <br />Officer Brawner testified he was dispatched to Chili's on a report of an intoxicated <br />party ordering food for takeout. When he arrived, the party was in a vehicle. He <br />and Officer Muldoon approached the vehicle and he asked the party to exit the <br />vehicle. The person, Scott Watson, was unsteady on his feet and used the door <br />for balance. Watson refused to do roadside maneuvers and was placed under <br />arrest for investigation of driving under the influence of alcohol. Watson reported <br />he had drinks at a friend's house and then drank four beers at the Back Room <br />and nothing since. He was transported to the Louisville Police Department and <br />blood was drawn for the blood/alcohol test. Officer Brawner described the <br />procedure for the test and reported the results came back with a 0.232 BAC. <br />Those results were entered into evidence. <br />Lauren Feijoo, a bartender and server at Chili's, was sworn in and testified. She <br />took a call for a takeout order from a gentleman who seemed very intoxicated. <br />When he came in for the order, he was stumbling. Feijoo got her manager and <br />stalled the individual while the manager called the police. <br />Mr. Newman asked Ms. Feijoo if she heard any background noise when she took <br />the call for the takeout food. She responded she did not recall. <br />Mr. Fredericksmeyer asked Ms. Feijoo if Mr. Watson had any drinks at Chili's. <br />She responded he did not. <br />Tarene Jacobs was sworn in and testified. She testified she was the bartender <br />on the night in question and was not an experienced bartender. She, however, is <br />getting her masters degree in family therapy and believes she would be very able <br />
