health of adolescents, young adults and young mothers who would be deterred from smoking, as <br />well as their children; and <br />WHEREAS, by raising the minimum legal age to purchase tobacco products, including <br />electronic smoking devices and related products, to 21 instead of 18, legal purchasers will be less <br />likely to be in the same social networks as high school students and, therefore, less able to sell or <br />give cigarettes to them; and <br />WHEREAS, the City Council finds that this ordinance furthers and is necessary for the <br />protection of the public health, safety and welfare. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Title 9 of the Louisville Municipal Code is hereby amended by the addition <br />of a new Chapter 9.78 to read as follows: <br />Chapter 9.78 <br />Tobacco Products <br />Sec. 9.78.010. Intent. <br />It the intent of this Article to protect the health, safety and welfare of persons <br />under the age of twenty-one (21) years by prohibiting the sale of tobacco, e- <br />cigarettes, vaporizers and similar products to persons under the age of twenty-one <br />(21). <br />Sec. 9.78.020. Definitions. <br />For purposes of this Article, the following words shall have the meaning <br />ascribed hereafter: <br />Electronic smoking device means an electronic or battery -operated device <br />that provides a vapor of nicotine or any other substance and the use or inhalation <br />of which simulates smoking. This term shall include every variation and type of <br />such devices whether they are manufactured, distributed, marketed, or sold as an <br />electronic cigarette, electronic cigar, electronic cigarillo, electronic pen, electronic <br />pipe, electronic hookah, vape pen, vape mod or any other product name or <br />descriptor for such devices and includes any product intended for use with an <br />electronic smoking device, including refills, cartridges, and component parts of a <br />product whether or not marketed or sold separately. "Electronic smoking device" <br />does not include an inhaler, nebulizer, or vaporizer that is approved by the federal <br />Food and Drug Administration ("FDA") for the delivery of medication. <br />Ordinance No. 1786, Series 2019 <br />Page 2 of 4 <br />
