In the course of his investigation, Mr. Joss stated that he reviewed the
officers' reports, spoke with the officers, and interviewed several persons at the restaurant. He came to
the conclusion that while there was an indication that a person was involved in an incident outside the
restaurant, there was no evidence that this person was physically intoxicated while inside the
establishment. All three violations alleged in the Order specifically address serving alcohol to a visibly
intoxicated or an apparently intoxicated person, and Mr. Joss stated that he did not have any evidence to
support those charges. He also noted that the owner, Bob Mannion, was very cooperative throughout
the investigation. On the basis of the facts of his investigation, Mr. Joss moved for a dismissal of the
Show Cause Order.

Co

Corporate Report of Changes - Albertson's Inc., d/b/a Albertson's Food Center #812 -
3.2 Percent Beer License (OffPremises) 910 West Cherry Avenue.

The Authority was notified of a change in Corporate Officers for Albertsons, Inc., effective June 22,
1999.
