ORDINANCE NO. 1789 <br />SERIES 2020 <br />AN ORDINANCE AMENDING CHAPTER 3.32 OF THE LOUISVILLE MUNICIPAL <br />CODE CONCERNING ADMINISTRATION OF THE RETAIL MARIJUANA <br />CULTIVATION FACILITY TAX AND AMENDING CHAPTER 5.11 OF THE <br />LOUISVILLE MUNICIPAL CODE REGARDING RETAIL MARIJUANA SALES TO <br />NONRESIDENTS OF THE STATE OF COLORADO <br />WHEREAS, the City of Louisville (the "City"), is a Colorado home rule municipal <br />corporation duly organized and existing under laws of the State of Colorado and the City of <br />Louisville Home Rule Charter (the "City Charter"); and <br />WHEREAS, the members of the City Council of the City (the "City Council") have been <br />duly elected and qualified; and <br />WHEREAS, Article X, Section 20 of the Colorado Constitution, also referred to as the <br />Taxpayer's Bill of Rights ("TABOR") requires voter approval for any new tax, any increase in <br />any tax rate, the creation of any debt, and the spending of certain funds above limits established <br />by TABOR; and <br />WHEREAS, pursuant to Article 12 and Section 4-8 of the City Charter, the City Council <br />may authorize the imposition of new taxes by ordinance and upon approval of the registered <br />electors of the City; and <br />WHEREAS, pursuant to Section 7-6 of the City Charter, the City Council adopted <br />Ordinance No. 1776, Series 2019, which submitted to a vote of the registered electors of the City <br />Ballot Issue No. 21), Retail Marijuana Cultivation Facility Excise Tax, and which Ballot Issue <br />was approved by the voters; and <br />WHEREAS, in addition to submitting the Ballot Issue to the City's voters, Ordinance <br />No. 1776 added a new Chapter 3.32 to the Louisville Municipal Code concerning the Retail <br />Marijuana Cultivation Facility Tax; and <br />WHEREAS, the City's finance department has identified certain provisions that would <br />be helpful to the efficient and effective collection and administration of the tax, and provide <br />better service to the City's businesses and taxpayers subject to the excise tax; and <br />WHEREAS, such administrative provisions set forth herein are not intended, and shall <br />not be construed, to extend or increase the application, rate, or amount of tax or constitute a tax <br />policy change directly causing a net tax revenue gain or decrease from the retail marijuana <br />cultivation facility excise tax approved by Ballot Issue No. 21); and <br />Ordinance No. 1789, Series 2020 <br />Page 1 of 5 <br />
