Second Reading Amendments <br />Ordinance No. 1791, Series 2020 is revised to read as follows (amendments are shown in bold underline <br />and boldstrilreou4): <br />ORDINANCE NO. 1791 <br />SERIES 2020 <br />AN ORDINANCE AMENDING VARIOUS PROVISIONS OF THE LOUISVILLE <br />MUNICIPAL CODE REGARDING WATER AND SEWER TAP FEES <br />WHEREAS, the City Council is authorized by the Louisville Home Rule Charter and state <br />law, including but not limited to Charter Section 13-2 and C.R.S. §§ 31-15-708 and 31-35-101 et <br />se ., to regulate the use of the City water system, to establish the requirements for use of such <br />system, and to from time to time fix, establish, maintain, and provide for the collection of rates, fees, <br />and charges for water services furnished by the City; and <br />WHEREAS, the City Council has determined that dedication and conveyance of water <br />rights to the City may be considered in lieu of cash payment of the water resources portion of <br />the tap fee; and <br />WHEREAS, the City Council has determined that it is appropriate to revise certain <br />provisions of the Louisville Municipal Code regarding water and sewer tap fees as set forth herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 13.12.040.A of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined; words deleted are sue): <br />A. Except as set forth in subsection E below, the The tap fee shall be computed <br />by reference to the provisions of this chapter and set forth in a table of fees <br />established by the city manager. The city manager shall by order enacted <br />and effective on the effective date of Ordinance No. 1633, Series 2013, and <br />thereafter on January 1 of each year, establish a table of city water tap fees. <br />Section 2. Section 13.12.040 of the Louisville Municipal Code is hereby amended by <br />the addition of a new subsection E to read as follows: <br />E. iftheThe city manager or superintendent may, in their discretion, <br />consider and accept the dedication and conveyance of a water right to <br />the city, as set forth in this subsection E, in lieu of cash payment for <br />water resources and water supply. Under this subsection E, a water <br />right means a decreed right to use, in accordance with priority, a certain <br />portion of the waters of the state by reason of the appropriation of the <br />same and includes both direct flow and storage rights.
