ATTORNEY'S REPORT

Chairperson Jeffers returned to the meeting and asked for the Attorney's Report.

Attorney Light discussed an issue relative to Carrabba's Italian Grill. Light stated that at the City Council
meeting, the PUD for Carrabba's Italian Grill requested an outdoor patio area where drinks could be
served. Light stated the minutes of the Authority's public hearing for Carrabba's did not reflect any
request, discussion or approval concerning this type of area. He asked the Authority if it felt the
applicant represented the licensed premises would extend to an outdoor seating area, or whether its
approval was intended to include such an area.

Attorney Light and the Authority members examined the PUD submitted to the City Council and the
diagram submitted for the liquor license. All the Authority members were in agreement that the applicant
did not represent that an outdoor patio seating area, where drinks could be served, was included in their
request. Members of the Authority expressed concern that there would not be a railing around the
outdoor patio area. They also felt there would be problems monitoring patrons drinking in the outdoor
area.

Attorney Light was directed to contact the applicant and request that they attend the November 29, 1999
Authority meeting to discuss those issues and concerns.

AUTHORITY COMMENTS

None.

ADJOURNMENT

ATTEST:

Steve Jeffers, Chairperson

Nancy-Var~ Secretary to the Authority
