Posted in City Hall, Public Library, <br />Recreation Center and Courts and Police Building and mailed to surrounding <br />property owners on January 26, 2009. <br />Conflict of Interest and Disclosure: <br />None heard. <br />Staff Report of Facts and Issues: <br />Staff distributed a new site plan. Pritchard moved and Tengler seconded a <br />motion to enter into the record the new site plan. Motion passed by voice vote. <br />McCartney presented the following summary: <br />• A request for a Special Review Use permit 6to allow for the placement of <br />an Alternative Tower Structure (ATS) CMRS facility on property owned by <br />ConocoPhillips. <br />• 2270 South 88th Street. <br />itit <br />▪ Applicant is Sprint Nextel, representedlby Peter Van Wickler. <br />• There is currently cellular equipment located on the roof of building 2A. <br />• According to the letter of intent, the applicant has stated that the ATS will <br />act as a temporary solution for cell equipment placement until <br />ConocoPhillips has constructed a new building in the immediate location. <br />• Two alternative designs for the proposed ATS were presented. <br />1) A "monopine" designed to look like a pine tree. <br />2) An ATS designed to match the existing Excel Energy transmission <br />poles located on the property. <br />Requested height is 80 feet <br />• The setbacks (front, 20 feet; side, 10 feet and rear, 20 feet) for the <br />proposed ATS comply with the required setbacks. <br />Ground Mounted Mechanical units (GMMU), approximately 10 feet by 15 <br />feet, are proposed adjacent to the ATS. <br />Staff concluded with a review of the SRU Criteria and stating that all five (5) <br />criteria had been met. <br />Commission Questions: <br />Lipton and Loo had questions of the birds and why the concern for their nesting. <br />McCartney stated the concern was for the migrating birds. <br />Lipton asked if staff or the applicant knew the true difference in the elevation and <br />the reason for the 80-foot tower height. <br />McCartney confirmed that would be a question for the applicant. <br />Loo asked if the Rocky Mountain Airport had been contacted. <br />McCartney stated the airport had been included as one of the referral agencies <br />but no comment had been received from them. <br />Tengler asked why a new location had to be selected. <br />
