RESOLUTION NO. 02 <br />SERIES 2009 <br />A RESOLUTION RECOMMENDING APPROVAL OF A <br />SPECIAL REVIEW USE (SRU) FOR THE PLACEMENT OF AN ALTERNATIVE <br />TOWER STRUCTURE (ATS) CMRS FACILITY ON PROPERTY OWNED BY <br />CONOCOPHILLIPS (2270 SOUTH 88th STREET) <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for approval of a special review use (SRU) for the placement of an <br />Alternative Tower Structure (ATS) CMRS facility on property owned by ConocoPhillips; <br />and <br />WHEREAS, the City Staff has reviewed the information submitted and found it, <br />with conditions, to comply with Louisville zoning regulations, including the City's special <br />review use criteria and other applicable sections of the Louisville Municipal Code; and <br />WHEREAS, after a duly noticed public hearing on February 12, 2009, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated February 12, 2009, the Planning <br />Commission finds that said special review use should be approved, with the following <br />conditions: <br />1. The proposed ATS shall be designed as a monopole painted to match the cortan <br />of existing Excel transmission poles. <br />2. The Special Review Use is granted to the applicant only. <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the <br />City of Louisville, Colorado does hereby approve a special review use (SRU) for the <br />placement of an Alternative Tower Structure (ATS) CMRS facility on property owned by <br />ConocoPhillips, subject to the above conditions. <br />Attest: <br />PASSED AND ADOPTED this 12th day of February 2009. <br />By: <br />Susan S.
