Staff requests to defer <br />request until final PUD. <br />o Street Trees: Requirement is 1 per 20'; Applicants asks for 1 per 50' for Lots 1-3. <br />Staff does not recommend approval of this waiver as street trees are a key <br />design feature. <br />• Recommendation: <br />o Staff recommends approval of the requestliO ning change, SRU, preliminary <br />plat, and preliminary PUD for the developrWnt called DELO Flats. <br />o Staff recommends the following conditions of approval: <br />• Defer the sidewalk width waiver request until final submittal. <br />• Remove any reference to a street tree allotment of 1 street tree per 50 feet of <br />street frontage. <br />• Easement concerns, with the Louisville Trade Center Plat, will be resolved <br />prior to final approval. <br />• The Applicant shall demonstrate architectural details for the residential <br />buildings along Cannon Street at final PUD. <br />Staff Recommendations: <br />Staff recommends Planning Commission move to approve Resolution 27, Series 2015, A <br />resolution recommending approval of a replat and rezoning for 4.39 acres which includes a 2.39 <br />acre preliminary PUD, and Special Review Use (SRU) within the core area of the Highway 42 <br />Revitalization District. If approved, the project area would be rezoned from Industrial (I) to <br />Mixed -Use Residential (MU-R) and Mixed -Use Commercial (MU -CC) and developed to include <br />33 apartments, 13 live -work units, and 10,000 SF commercial floor area. <br />Email Submittal: <br />Email from Cyndi Summers dated Thursday, September 10, 2015. We have <br />8' to 12' widths in some areas along Main Street. <br />Brauneis asks when was the MUDDSG created? <br />McCartney says approximately in 2007. <br />Russ says this is not a unique situation. Coal Creek Station came forward with a proposed alley <br />on BNSF property. At preliminary, it is about use and the site design needs to be resolved. We <br />made it clear and put a condition on the approval that prior to approval, the alley right of way <br />must be resolved with BNSF. The PC has not seen Coal Creek Station because they are still <br />
