his date of birth and state his age. The suspect stated that he was only 20 years old. The officer saw a <br />box in the backseat, which he thought, contained alcohol. He asked the suspect what was in the bag, and <br />was told by the suspect that it was alcohol that he just bought at L&G Liquors. The officer spoke with <br />the passenger and was told that she was also only 20 years of age. The suspect was written summons for <br />minor in possession of alcohol, and given a warning of the traffic violation "Failure to Stop at Stop Sign," <br />The officer then went back to L&G Liquors spoke with the owner, Gary Galvin. He told Mr. Galvin that <br />Mr. Paul Jellema, had said that he bought liquor from L&G Liquors. He asked Mr. Galvin if he had sold <br />alcohol to Mr. Jellema, and described the person to him. Mr. Galvin told the officer he did not sell <br />alcohol to this gentleman. The officer went to his vehicle and collected the box of alcohol, to show Mr. <br />Galvin. The officer stated that the gentleman he stopped also had a small bottle of gin, which he also <br />brought to show Mr. Galvin. Mr. Galvin told the officer that he could not remember selling to this <br />person. The officer asked Mr. Galvin why he did not remember Mr. Jellema, when the alcohol sale <br />occurred within the last twenty minutes. The officer summonsed Mr. Galvin for selling to persons <br />prohibited. <br /> <br />Attorney Barnett asked if the officer if Mr. Paul Jellema was the individual he identified to Mr. Galvin and <br />if the suspect was the twenty-year old that he stopped. <br /> <br />Officer Moua stated that it was the same person, with the same name. <br /> <br />Attorney Barnett asked the officer to indicate the approximate time between when he believes the <br />purchase of alcohol was made, to when the officer actually went to question Mr. Galvin at the liquor <br />store. <br /> <br />Officer Moua stated that he believed that it was anywhere from fifteen to twenty minutes. <br /> <br />Attorney Barnett had no further questions of Officer Moua. <br /> <br />Cross Examination <br /> <br />Attorney Rennich stated to the officer that his report did not say that Mr. Galvin didn't remember selling <br />to the individual but what the report stated was that Mr. Galvin said "I don't remember selling to a <br />minor." He asked Officer Moau to confirm that statement. <br /> <br />Officer Moau confirmed that was correct. <br /> <br />Attorney Rennich asked Chairperson Jeffers if he could have an exhibit marked and then approach the <br />witness afterwards. <br /> <br />Chairman Jeff`ers agreed, and the Secretary marked a colored copy ora Utah Drivers License as Exhibit <br />gA. <br /> <br />Attorney Rennich asked if the officer remembers what Mr. Jellema looks like. <br /> <br />Officer Moau stated that he was not exactly sure. <br /> <br />Attorney Rennich approached the witness and asked him to look at Exhibit gA and if he could identify it <br /> <br /> <br />
