Resolution No. 28, Series 2020 <br />Page 1 of 2 <br />RESOLUTION NO. 28 <br />SERIES 2020 <br />A RESOLUTION POSTPONING WASTEWATER AND STORMWATER RATE <br />INCREASES <br />WHEREAS, the Louisville Municipal Code authorizes the City Council to establish <br />certain fees, rates, and charges by resolution, including those for City water, wastewater, and <br />stormwater; and <br />WHEREAS, the Novel Coronavirus 2019 (COVID-19) Pandemic is causing widespread <br />human and economic impacts to the City of Louisville; and <br />WHEREAS, on March 10, 2020, the Governor of the State of Colorado issued a <br />Declaration of Statewide Emergency in response to COVID-19; and <br />WHEREAS, on March 15, 2020, the Mayor of the City of Louisville, pursuant to <br />Chapter 2.32 of the Louisville Municipal Code and C.R.S. § 24-33.5-709 executed a Declaration <br />of Local Disaster Emergency in and for the City of Louisville (the “Mayor’s Declaration”); and <br />WHEREAS, at an emergency meeting held on March 16, 2020, the City Council <br />adopted Resolution No. 27, which continued in effect the Mayor’s Declaration until terminated <br />by resolution of the City Council; and <br />WHEREAS, by Resolution No. 20, Series 2020, adopted on March 3, 2020, the City <br />Council approved an increase in wastewater and stormwater rates effective May 1, 2020, with <br />water rates remaining unchanged; and <br />WHEREAS, the City Council finds the full economic impacts of COVID-19 cannot be <br />determined at this time, but it is likely that Louisville residents may find themselves unable to <br />meet important financial obligations; and <br />WHEREAS, the City Council further finds that financial modeling for the wastewater <br />and stormwater funds reflects that postponing the scheduled rate increases will have a limited <br />impact on those utility funds in the short term and sufficient reserves are available to meet <br />current budget levels; and <br />WHEREAS, it is appropriate and in the interests of the City and its residents to postpone <br />the scheduled rate increases by repealing Resolution No. 20, Series 2020, with the effect that <br />City water, wastewater, and stormwater utilities will continue to be charged at the current rates.
