Lipton asked if anyone present had any objection to the boundaries of the neighborhood being the current <br />boundaries of the City of Louisville? Hearing none, the Authority proceeded with the public hearing. <br /> <br />Lipton moved that the complete application as contained in the Authority packets be made a part of the <br />Record of this heating. Kimmett seconded the motion. All members were in favor, the motion was <br />adopted. <br /> <br />Lipton asked the applicant to come forward, state his name and address for the record and be sworn in. <br /> <br />The applicant stated his name, and address, David Fan, 2850 E. Aurora Avenue #307, Boulder, CO <br />80303. <br /> <br />The Secretary asked the applicant to raise his right hand and proceeded with the oath. "Do you solemnly <br />swear or affirm under penalty of perjury that the testimony you are about to give will be the truth, the <br />whole truth, and nothing but the truth". <br /> <br />Mr. Fan: I do. <br /> <br />Lipton asked the applicant to make a presentation. <br /> <br />Mr. Fan stated that he and his mother are the applicants for a hotel & restaurant liquor license, for Spice <br />China Restaurant, located at 269 McCaslin Blvd. He explained that the restaurant is approximately 6,000 <br />square feet. It will include a patio that is located on the south side of the building. The patio area will be <br />enclosed by a wall, and entry to the patio will be through the restaurant. The patio also includes an <br />emergency exit, which is located on the west side of the patio. <br /> <br />Lipton asked the height of the wall. <br /> <br />Mr. Fan stated that the wall is a three-foot brick construction, with a metal fence, which will extend the <br />wall height to five and one half feet. <br /> <br />Jeffers asked Mr. Fan to address the petition, which was submitted to show the needs and desires of the <br />neighborhood. <br /> <br />Mr. Fan stated that he did not personally circulate the petition. The petition was circulated by two <br />friends within a two-week span. The petition circulators went door-to-door within the immediate <br />neighborhood of the restaurant location. Many signatures were gathered in residential areas and the <br />apartment complexes located across from the restaurant. Several local businesses also signed the <br />petition. Mr. Fan stated that only two people did not wish to sign the petition because it dealt with the <br />sale of liquor. Mr. Fan also stated that those who signed the petition said they were happy to see the <br />restaurant going in. <br /> <br />With respect to the diagram, Kimmett asked what the two diamond shapes represented. <br /> <br />Mr. Fan stated that they were dining areas. There would be four different dining areas inside the <br />restaurant. <br /> <br />4 <br /> <br /> <br />
