0 0 <br />LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />JUNE 17, 1992 <br />ITEM: Jean Morgan - Special Exception Permit <br />Public Hearing <br />APPLICANT: Jean Morgan, 1131 Spruce Street <br />LOCATION: 1117 Spruce Street - (Lots 8 and 9, except the <br />south 28 feet thereof, in Block 3, East Louisville, <br />an addition to the Town of Louisville, County of <br />Boulder). <br />OWNER: Jean Morgan <br />ZONING: Residential Medium Density - RM <br />REQUEST: <br />The applicant is requesting a Special Exception Permit to replace <br />a single family structure within the 100 year flood plain. <br />BACKGROUND: <br />Pursuant to Section 17.56.170B of the Louisville Municipal Code <br />(LMC), a single family home is considered a restricted use within <br />the flood regulatory district. Prior to issuance of a building <br />permit such a use must be authorized by the Board. <br />On April 15th of this year the Board granted two setback variances <br />to the applicant to replace an existing 590 s.f. residence on the <br />subject property. The applicant has submitted building plans to <br />construct a 576 s.f. (24' x 24') with an attached single car (14'x <br />24') garage subject to setback variances granted in April. <br />Upon review of building plans, staff reviewed the flood plain <br />designation provided on the applicant's Improvement Location <br />Certificate (ILC). The ILC certified the property as being in a <br />Zone C or outside the 100 year floodplain. Based on the most <br />current Flood Insurance Rate Maps (7/15/88), staff contested the <br />designation and advised the applicant that the property was within <br />Zone A, or within the 100 year floodplain. <br />The Building Division has not received building plans at this time. <br />
