Pc <br />RESOLUTION NO. 54 <br />SERIES 1994 <br />A RESOLUTION APPROVING A <br />FINAL PUD DEVELOPMENT PLAN <br />AND A FINAL PLAT FOR <br />LOTS 101, 102, 103 AND OUTLOT A, ASPEN GREENS SUBDIVISION <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for a Final PUD Development Plan and Final Plat for Lots 101, 102, 103 and Outlot <br />A, Aspen Greens Subdivision, for two office buildings, located west of Garfield Avenue and north <br />of South Boulder Road. <br />WHEREAS, the applicant is Regal Investment Associates, Ltd.; <br />WHEREAS, all materials related to the Final PUD Development Plan and Final Plat have <br />been reviewed by City staff and found to be in compliance with the Louisville zoning ordinances, <br />comprehensive plan, and other related policies; and, <br />WHEREAS, the Planning Commission finds that said Final PUD Development Plan and <br />Final Plat should be approved with the following condition: <br />1. Allow one monument sign on South Boulder Road and show on Final PUD; <br />2. A note shall be added to the PUD stating that a maximum of 40% of the <br />office space, for each building, may be leased for medical/dental office <br />use. Also, a note shall be added that the basement level is restricted to <br />storage and mechanical equipment only. Offices, restrooms, break rooms <br />or any other uses of the basements are prohibited; <br />3. Vacate a portion of the utility easement adjacent to South Boulder Road and <br />Outlot A, Lot 101 and Outlot B, per agreement with City Staff; <br />4. Show a detail of the project directory sign to be located near the entrance <br />at South Boulder Road; <br />5. Provide an indication on the Final PUD for a pedestrian easement for the existing <br />pedestrian/bikepath; <br />6. Applicant shall reach a written agreement with the Goodhue Ditch Company <br />regarding the section of the ditch to be modified and access across Outlot A; <br />
