Louisville Local Licensing Authority <br />Meeting Date: May 8, 2000 <br /> <br />without written consent, he would prepare and present a "legal brief" to the Authority outlining the <br />definition of consent and implied consent and prove that evidence of consent is provided in a <br />combination of legal documents and signed contracts. Further, Mr. Moore stated that he would <br />challenge the local rule 5(b) itself, proving it is onerous and detrimental to his clients Holly & Mike's <br />Ribs, Inc. <br /> <br />Jeffers asked attorney Kelly if notarized written consent is the only acceptable form of proof <br />according to the local rule, or whether other evidence of consent could be considered. Attorney Kelly <br />stated that it is one option for demonstrating assent, and that it is the responsibility of the applicant to <br />meet the burden of providing evidence from which the Authority can find substantial, competent <br />evidence of assent from the current license holders. <br /> <br />Member Turner asked how long the transfer of this liquor license has been pending. Authority <br />Secretary Varra stated that the original application was submitted in November of 1999. <br /> <br />Member Jeffers made a motion to table thetransfer application until a special meeting of the <br />LouisvilleLocal Licensing Authority to be held ,2000 at 7:30 p.m. Jeffers further requested <br />the Authority Secretary to post notice of the special meeting in accordance to the bylaws of the Local <br />Licensing Authority. Lipton seconded the motion. Roll Call Vote: Kimmett - yes, Lipton - yes, <br />Jeffers - yes, Evans - yes, Myers - yes. All members were in favor, motion carded. <br /> <br />Member Jeffers motioned for the Authority to go into Executive Session for the sole purpose of <br />consulting with the Authority Attorney on pending litigation. Member Lipton seconded the motion. <br />All members were in favor, motion carded. <br /> <br />Deputy City Clerk Bolte read the public statement regarding executive sessions, Section 2.90.050 <br />Public Statement, of the Louisville Municipal Code. The Authority adjourned into Executive Session <br />at 8:30 p.m. <br /> <br />Chairperson Myers reconvened the meeting at 8:50 p.m. and requested Authority Secretary Varra to <br />send a letter to the last known address of David L. and Barbara J. McCaslin Blvd. <br /> <br />Authority members briefly discussed the renewal application and were informed by the Authority <br />Secretary that the current license holder, Mr. Richard Eisenberg, stated he had not received a renewal <br />application from the state.
