LLity <br />L4 - LEGAL COMMITTEE <br />Louisville COMMUNICATION <br />COLORADO - SINCE 1878 <br />SUBJECT: DISCUSSION/DIRECTION — RESOLUTION AMENDING <br />PROCEDURES TO BE UTILIZED FOR QUASI-JUDICIAL <br />HEARINGS AT MEETINGS CONDUCTED BY ELECTRONIC <br />PARTICIPATION <br />DATE: <br />MAY 20, 2020 <br />PRESENTED BY: HEATHER BALSER, CITY MAANGER <br />KATHLEEN KELLY, CITY ATTORNEY <br />SUMMARY: Attached is a draft of a resolution amending procedures to be utilized for <br />quasi-judicial hearings at meetings conducted by electronic participation. The draft <br />amends the previously approved Resolution No. 30, Series 2020 regarding electronic <br />quasi-judicial hearings adopted by City Council on April 7, 2020. Also attached is a <br />blackline showing changes. The revisions to the previous resolution seek to clarify City <br />Council's policy regarding quasi-judicial hearings, particularly as it relates to matters that <br />may be heard by electronic participation. <br />Highlights of the changes include the following: <br />Matters for which Electronic Quasi -Judicial Hearings may be Held. Only the following <br />types of quasi-judicial hearings may be held at a meeting by Electronic Participation: <br />1. Land use applications the final decision regarding which is not <br />subject to referendum: Public hearings before City Council and all Appointed <br />Bodies may be held by Electronic Participation. These types of applications <br />include, but are not limited to, Planned Unit Development, subdivision plats, and <br />special review uses. <br />2. Land use applications the final decision regarding which is subject to <br />referendum: Public hearings before all Appointed Bodies may be held by Electronic <br />Participation, but City Council hearings must be held at an in -person meeting. <br />These types of applications include, but are not limited to, zoning and rezoning <br />applications, including applications for General Development Plans and <br />amendments thereto. <br />3. Historic Preservation applications. These types of applications <br />include, but are not limited to, landmark designations, landmark alteration <br />certificates, and demolition reviews. <br />4.
