RESOLUTION NO. 23 <br />SERIES 2003 <br />A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN <br />AND SPECIAL REVIEW USE FOR 625 MAIN STREET, <br />MOFFITT BUILDING AND LOFTS <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final PUD development plan and special review use for the construction of a <br />commercial/mixed-use building located at 625 Main Street; and <br />WHEREAS, all materials related to the final PUD development plan have been <br />reviewed by City Staff and the Planning Commission and found, with conditions, to be in <br />general compliance with the Louisville zoning ordinances, including the City special review <br />use criteria, the Downtown Design Handbook and Framework Plan; and <br />WHEREAS, after a duly noticed public hearing concerning said final PUD <br />development plan and special review use on July 17th, 2003, where evidence and testimony <br />were entered into the public record, including the Staff Report dated July 17th, 2003, the <br />Planning Commission recommended approval to the City Council, with conditions; and <br />WHEREAS, City Council has reviewed the application and finds that the applicant has <br />agreed to comply with all Planning Commission recommended conditions and City Council <br />further finds that the application should be approved, with the following conditions: <br />1. A parking summary shall be added to the Final PUD Development Plan, which reflects <br />that the required off-street parking requirement is 19 spaces. Two of the commercial <br />spaces will be limited to short term (20 minute) parking. Each of the residents will be <br />deeded two parking spaces, and the applicant will pay a parking improvement fee for <br />the shortfall of four commercial spaces. The parking improvement fee will be a total of <br />$14,400.00. The Parking Improvement Fee shall be paid in conjunction with the <br />issuance of the first building permit. <br />2. The PUD shall be modified to reflect the revised rear landscape planter dimensions on <br />all panels. <br />3. The photometric plan shall be modified to reflect pole locations as identified as fixture <br />'Type A'. The PUD should also incorporate cut -sheets for all fixture types. <br />4. The PUD shall be modified to eliminate the CMU within the planters located adjacent <br />to the right-of-way of Main Street. The planters should be constructed of brick, the <br />color of which ties in with the color of the pavers used within the City right-of-way. <br />1 <br />
