SUBJECT: QUASI-JUDICIAL HEARING OPTIONS <br />DATE: JULY 7, 2020 PAGE 2 OF 3 <br />This option would allow people to attend in -person to give comments. However, if there <br />were more than 19 people in attendance it would not allow for people to attend the <br />entire meeting in -person. People would have to be staged in a separate room and <br />brought in for public comments. <br />This option does allow for people at home to watch the meeting multiple ways including <br />on Comcast Channel 8, via Zoom, and streaming through the City's website on <br />YouTube. The last two can be done from a computer, tablet, smartphone or other smart <br />device. Zoom also allows people to call in from any phone to listen to the meeting and <br />comment. Anyone on Zoom either on a computer or the phone could also make public <br />comments. <br />As a legislative body Council is allowed to have in -person meetings under current State <br />rules. However, the Council could establish some data -driven criteria under which they <br />feel such a meeting could be held. <br />Besides social distancing, any in -person meeting will also include safety protocols <br />including mask wearing, limited access to touching surfaces, sanitation stations, and <br />extra cleaning. <br />One item of note is that the Brooks/Crown Room will not be available for City Council <br />meetings October 13 — November 5 as Boulder County is using the space as a Voter <br />Service and Polling Center. <br />Alternatively, Council could consider allowing electronic meetings for all public hearings <br />including land use applications the final decision of which is subject to referendum. For <br />electronic meetings staff is continuing to make the meetings more accessible. Towards <br />that end, staff is now providing a toll free option for people to use to phone into the <br />meeting, closed captioning is being worked out, and the call in number is being run on <br />Channel 8 during the live meetings so people may call in at the appropriate public <br />comment period. <br />With any of these options all of the standard Council processes will still apply. Proper <br />notice is required, public comments are limited to specific times on the agenda, and <br />everyone who is interested may have a chance to speak (either in -person or on the <br />phone/computer) for three minutes. <br />Changes to Rules of Procedure <br />Should Council want to allow for quasi-judicial hearings for items subject to referenda to <br />be heard at an electronic or hybrid meeting, Council would have to specifically allow that <br />with a new Resolution that would supersede Resolution No. 38 passed in June. Council <br />would also have to amend its Rules of Procedure to allow for a hybrid electronic/in- <br />CITY COUNCIL COMMUNICATION <br />
