She noted that the <br />property was privately owned, however the City of Louisville was the applicant and staff <br />had the owner's consent to conduct this application. The application included moving a <br />lot line, creating an outlot, and creating a dedication for state highway 42. <br />Staff recommends approval of Resolution 2, Series 2018 with the following condition: <br />Concurrent with the recordation of the plat, deeds shall be recorded which reflect the <br />revised legal description of each affected property. <br />Moline asked if the highway reservation was part of the replat and why it did not have a <br />label as a tract or something similar. <br />Ritchie replied staff would make sure the new version had a label. <br />Hsu made a motion to enter Sheet 2 into the record. Williams seconded. Voice vote. All <br />in favor. <br />Hsu asked if Outlot A was being created as part of the proposal. <br />Ritchie replied that it was an outlot, not a lot, so it was not for development per se. It <br />was an acceptable shape and location related to the subdivision ordinance. <br />Zuccaro added that staff used outlots on other developments for drainage and were not <br />measured against minimum lot widths, et cetera. <br />Hsu asked why the creation of an outlot need the change in the lot line between lots 2A <br />and 1 A. <br />Ritchie replied that they were unrelated requests, however the property owner and the <br />City desired to set forth the intent to link up Kaylix Avenue should the property be sold <br />or transferred. <br />Brauneis asked why it the lot line not straight. <br />Ritchie replied that the two parts of the avenue did not line up in a straight line. <br />Moline asked if in a future situation Lot 1A would have to be modified for Kaylix Avenue <br />development. <br />Ritchie confirmed that it would have to be modified and the City would have to go <br />through a right-of-way process. <br />Hsu asked if it would be possible to do the subdivision as part of a PUD. <br />Ritchie confirmed. <br />Hsu asked Ritchie to explain more of staff's reasoning for the modification criteria. He <br />stated that he was concerned the staff report was stretching the definition of "physical <br />circumstances or conditions" under modification criterion number one. Since the street <br />
