Planning Commission <br />Meeting Minutes <br />December 1211, 2019 <br />Page 9 of 13 <br />Brauneis asked staff what the requirement are for the compliance issues. for additional <br />public comments. Seeing none, he asked staff about the requirements for compliance <br />issues. <br />Zuccaro replied that there had been dirt storage on the property and the City currently <br />does not allow indefinite dirt storage on a property. How staff usually works with <br />applicants is that if you have civil plans on record and a storm water management plan <br />and a PUD you can start bringing dirt onto the site. Staff was trying to make sure that <br />they move forward with the project. If they did not, they would have to grade the dirt and <br />revegetate. Zuccaro noted that if weeds exceeded a certain height that is typically <br />turned over to Code Enforcement and they will contact the property owners to address <br />the issues. <br />Hoefner asked how this condition could have lasted for so long. <br />Zuccaro replied that that the owners had been allowed to store dirt on the property, <br />which would be needed for their project, with the expectation that they would proceed <br />with the project. The project has stalled significantly, which was not expected when the <br />dirt was originally moved to the property. <br />Brauneis asked when something like this would be enforced. <br />Zuccaro replied that if there were an enforcement issue staff could take action on that <br />regardless of the PUD extension. <br />Rice asked if there could be conditions attached to the PUD extension. <br />Zuccaro replied that he did not know if the condition could be made unless it were tied <br />to a specific criteria. <br />Rice replied that this was not typical and asked if they could grant a shorter extension. <br />Zuccaro confirmed that a shorter extension could be granted. <br />Hoefner noted that the PUD expired earlier in December. <br />Ritchie replied that the PUD didn't technically expire but that a permit could not be <br />issued without an extension. <br />Hoefner asked if they had to act tonight and wondered if they could ask the applicant to <br />go back and be a good neighbor and take the extension up at another time. <br />Rice replied that the same issue came up with the Foundry and had the same <br />discussion and granted a one year extension. <br />Brauneis stated three years was what is typically asked for since the original approval is <br />three years and asked about the requirement for reseeding. <br />11 <br />
