Planning Commission <br />Meeting Minutes <br />March 12, 2015 <br />Page 2 of 12 <br />Staff Report of Facts and Issues: <br />McCartney presented from Power Point: <br />• Location on east side of Centennial Drive with BNSF to the east. On the north, there is <br />Louisville Vet Clinic and to the south, it is vacant. Across the street, there are <br />townhomes. <br />• Zoned Community -Commercial (CC). For this use to be allowed in CC, it requires an <br />SRU. In 1983, La Petite Academy applied for this same type of SRU. The business <br />lasted from 1983-2009. La Petite had 108 students, ages 2 and up, had parking for 12 <br />cars, and had a playground in back. There was one modification in their time period to <br />add a fence for the playground. <br />• This proposal is for Active Louisville Kids to use the building exactly as built. There will <br />be no modifications to the site plan. Simple modifications such as general upkeep for the <br />exterior (painting). They will do interior work because there are code requirements based <br />on their State license. <br />• The applicant has a business in Boulder called Active Boulder Kids. <br />• Louisville Active Kids will have 75 to 90 children, ages 2.5 to 8. <br />• The business will have 10 to 14 full time staff members. It will operate Monday through <br />Friday from 7:30 to 5:30. <br />• Majority of drop-offs will be after 8:30 am. <br />Five criteria required for SRU. Staff believes all five criteria are met. <br />1. That the proposed use/development is consistent in all respects with the spirit and intent <br />of the comprehensive plan and of this chapter, and that it would not be contrary to the <br />general welfare and economic prosperity of the city or the immediate neighborhood, <br />2. That such use/development will lend economic stability, compatible with the character of <br />any surrounding established areas; <br />3. That the use/development is adequate for the internal efficiency of the proposal, <br />considering the functions of residents, recreation, public access, safety and such factors <br />including storm drainage facilities, sewage and water facilities, grades, dust control and <br />such other factors directly related to public health and convenience; <br />4. That external effects of the proposal are controlled, considering compatibility of land use; <br />movement or congestion of traffic; services, including arrangement of signs and lighting <br />devices as to prevent the occurrence of nuisances; landscaping and other similar <br />features to prevent the littering or accumulation of trash, together with other factors <br />deemed to affect public health, welfare, safety and convenience; <br />5. That an adequate amount and proper location of pedestrian walks, malls and <br />landscaped spaces to prevent pedestrian use of vehicular ways and parking spaces and <br />to separate pedestrian walks, malls and public transportation loading places from <br />general vehicular circulation facilities. <br />Staff Recommendations: <br />Staff finds the proposed use is consistent with the criteria for approval of a special review use. <br />The school will fill a vacant commercial space, provide a valuable service to the Louisville <br />citizenry, and will not have any foreseeable adverse effects on the surrounding neighborhood. <br />Staff recommends Planning Commission move to approve Active Louisville Kids, Resolution <br />No. 18, Series 2015, a request for a special review use (SRU) for the placement of a <br />daycare/pre-school in a previous daycare/pre-school located at 1970 Centennial Drive. <br />Commission Questions of Staff.- <br />Tengler asks for clarification regarding age range. The applicant's response states it is 6 weeks <br />to 6 years. <br />McCartney says the applicant can answer this question. <br />
