Planning Commission <br />Meeting Minutes <br />October 13, 2016 <br />Page 9 of 31 <br />Staff Recommendations: <br />Staff recommends Planning Commission move to approve Foundry Replat, Resolution 23, <br />Series 2016. A resolution recommending approval of an amendment to the Foundry subdivision <br />final plat. <br />Commission Questions of Staff: <br />Hsu says can you focus on what lines are changing. <br />Robinson says Blocks 1, 2, 3, and 4 are the residential buildings. In the new proposed plat, the <br />lots are expanded and the outlot that separated them, the drive aisle, parking, and landscaping, <br />has expanded to absorb it. The proposal is to get the parking on the same lot as the residential <br />buildings. <br />Moline says it looks like the land ownership associated with the access areas is adjusting. The <br />traffic flow remains the same. <br />Robinson says yes. Initially, it was one outlot where the drive aisles were. Now it is being split <br />in half for residential versus commercial association. There is still an access easement with one <br />drive aisle to serve the whole development. <br />Applicant Presentation: <br />Justin McClure, RMCS Inc., 1002 Griffith Street, Louisville, CO <br />Alex Carlson and David Waldner <br />Due to construction defect liability, there are two unique products that we are providing within <br />the Foundry development. According to my lenders and legal counsel, we need to do a better <br />job on our plat to separate the commercial and residential uses. There are three primary <br />changes. <br />1. Looking at the Staff presentation, Block 1 is smaller in the previous plat than in the <br />proposed because we need to pick up the garages. They did not belong in the tract <br />but in the block for legal reasons. <br />2. The second change is the drive aisle needed to be split into two separate tracts. The <br />western portion of the street can be specifically owned and maintained by the <br />residential portion. The eastern portion will be owned and maintained by the <br />commercial. <br />3. We had an outlying garage hanging in commercial land. It needed to be restricted for <br />construction defect liability. <br />These changes have resulted in a significant delay. We have not developed for -sale condos to <br />date and are going through the challenges currently. <br />Commission Questions of Applicant: None. <br />Public Comment: None. <br />Summary and request by Staff and Applicant: <br />Staff recommends approval of Foundry Replat, Resolution 23, Series 2016. A resolution <br />recommending approval of an amendment to the Foundry subdivision final plat. <br />Closed Public Hearing and discussion by Commission: <br />Rice says this is a legal change that the applicant needs. I don't think it changes anything in <br />terms of how we view this from a planning perspective. I support the change. <br />O'Connell in support. Brauneis in support. Moline in support. Hsu in support. <br />Motion made by Brauneis to approve Foundry Replat, Resolution 23, Series 2016. A <br />resolution recommending approval of an amendment to the Foundry subdivision final plat, <br />seconded by Moline. Roll call vote. <br />
