Louisville Local Licensing Authority <br />Meeting Date: September 18, 2000 <br />Page 2 <br /> <br />Chairperson Myers noted that both applicants should provide the Authority a copy of their Certificate of <br />Good Standing, that Union Jack Liquor should clarify that they are leasing the licensed premises, and <br />that Bag's should indicate date of filing of last annual corporate report in response to question 9c. <br /> <br />AUTHORITY BUSINESS - None <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />A. Incident Report - L & G Liquors <br /> <br />Officer Jokerst summarized a police report that detailed the theft of two alcoholic beverages by two <br />juveniles from L & G Liquors. The licensee contacted the police department as required and opted not <br />to press charges against the youths. <br /> <br />Members briefly discussed the incident, concluding that the licensee committed no violations. <br /> <br />SECRETARY'S REPORT <br /> <br />A. Taj Mahal III <br /> <br />Deputy City Clerk Bolte introduced a renewal application received from Taj Mahal III on Friday, <br />September 15, 2000. She noted the timeline prepared for Authority review stating a long history leading <br />up to the receipt of the renewal. <br /> <br />Chairperson Myers asked Authority Attorney Kelly for her legal appraisal of the renewal application. <br />Attorney Kelly stated that based on information received by the City Clerk's office, the ownership status <br />of Taj Mahal III is in question and the registered manager for the licensed premise is believed to be <br />currently residing in another state. <br /> <br />Attorney Kelly briefly reviewed the content of letters sent to Taj Mahal III citing state statutes requiring <br />notification of any change in ownership or ownership structure as well as managerial changes to both <br />local and state authorities. <br /> <br />Attorney Kelly summarized for members of the Authority that based on information conveyed to the <br />City Clerk' s office, the accuracy of the information provided on the renewal application is questionable. <br />She continued that she recommended a hearing on the renewal application and the appointment of a <br />Special Prosecutor to the Authority. The purpose of the Special Prosecutor would be to conduct some <br />fact-finding for the Authority and to present witnesses for testimony at the hearing. Because there is a <br />possibility the Authority could ultimately take action adverse to the licensee, appointment of a Special <br />Prosecutor would also ensure there is a good record in the event the Authority's action is challenged. <br /> <br />2 <br /> <br /> <br />
