RESOLUTION NO. 50 SERIES 2020 A RESOLUTION CALLING A SPECIAL ELECTION FOR NOVEMBER 3, 2020, TO BE CONDUCTED AS A COORDINATED ELECTION, FOR THE PURPOSE OF SUBMITTING TABOR BALLOT ISSUES TO THE REGISTERED ELECTORS OF THE CITY AND FOR THE ELECTION OF A WARD 3 COUNCILMEMBER WHEREAS, a statewide general election will occur on November 3, 2020; and WHEREAS, a vacancy in the office of Councilmember for Ward 3 was created upon the election on November 5, 2019 of Ashley Stolzmann to the office of Mayor; and WHEREAS, on January 7, 2020 pursuant to Section 3-6(b)(2) of the Home Rule Charter, the City Council appointed a Councilmember to fill a vacancy in Ward 3 to hold office until the date of the statewide general election, on which date a special election shall be held for election to fill the vacancy; and WHEREAS, the City Council finds it in the best interests of the City of Louisville to call a special election for November 3, 2020 for the purpose of filling the Ward 3 vacancy and referring to the registered electors of the City TABOR ballot issues concerning proposed City taxes; and WHEREAS, pursuant to Section 6-3 of the Home Rule Charter, the City Council may call a special election by resolution adopted not less than 60 days prior to the date of the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. A special election is hereby called to be held on Tuesday, November 3, 2020 as part of a coordinated election. Section 2. The purpose of the special election will be an election to fill a vacancy in the office of Councilmember for Ward 3 and to submit to the registered electors of the City TABOR ballot issues concerning proposed City tax increases. The City Council may submit such TABOR ballots issues to appear on the ballot of the special election by the adoption of appropriate resolutions or ordinances as required by law. Section 3. The officers and employees of the City are hereby authorized and directed to take all necessary and appropriate actions to effectuate the provisions of this Resolution in accordance with Colorado law. Section 4. Pursuant to C.R.S. Section 31-10-102.7, the City will utilize the requirements and procedures of the Uniform Election Code of 1992, articles 1 to 13 of title 1, C.R.S., as amended, in lieu of the Colorado Municipal Election Code of 1965, article 10 of title Resolution No. 50, Series 2020 Page 1 of 2
