Louisville Local Licensing Authority <br />Meeting Date: November 27, 2000 <br />Page 11 <br /> <br />Member Turner and Vice Chairperson Lipton asked about the history of Mr. Min's restaurant. Attorney <br />Gottesfeld stated that the strip mall property is owned by Columbine West LLC and that there have been <br />a string of unsuccessful businesses, the most recent, A Cut Above Italian Deli from whom Mr. Min <br />obtained his current sublease in April. <br /> <br />Members reviewed the lease documents included in the packets and again discussed the timing for <br />obtaining the prime lease and assent of the landlord. <br /> <br />Attorney Gottesfeld reiterated that the prime lease would be obtained tomorrow and the assent from the <br />landlord within the next ten days. Attorney Gottesfeld continued that Mr. Min has been operating the <br />restaurant since April, that the restaurant is fairly successful and that patrons have requested that beer, <br />wine and sake be made available. <br /> <br />Member Jeffers stated that, in his mind, the application is incomplete and that the matter should be <br />continued to the next regularly scheduled meeting December 18, 2000. He suggested that members <br />review the application materials and advise the applicant of any other deficiencies so that those matters <br />could be cleared up prior to the next meeting. <br /> <br />Attorney Gottesfeld stated that there were witnesses present to testify to the needs and desires of the <br />neighborhood and asked if such testimony could be given at this evenings hearing so that the witnesses <br />would not have to come back a second time for the December 18, 2000 meeting. <br /> <br />Authority Attorney Kelly advised members that according to the Rules of Procedure, if they determine <br />the application to be incomplete, no action should be taken on the application, including witness <br />testimony, other than to continue the matter to the next meeting of the Authority. <br /> <br />Member Kimmett questioned if the petition submitted by the applicant could be used to establish the <br />needs and desires in lieu of having witnesses present at the next hearing date. Attorney Kelly stated that <br />the applicant has a choice of providing witness testimony and/or a petition. She continued that, in the <br />past, the Authority has accepted petitions as evidence to the needs and desires issue. <br /> <br />Member Jeffers moved to continue the public hearing for Byung U. Min d/b/a Little Tokyo, 332 <br />McCaslin Blvd., to the next regularly scheduled meeting December 18, 2000. Member Evans seconded <br />the motion. Roll Call Vote: Turner - yes, Lipton - yes, Evans - yes, Jeffers - yes, Kimmett - yes. All <br />members were in favor, the motion carried. <br /> <br />Attorney Gottesfeld asked if members of the Authority required any further documents or information <br />prior to the next meeting. Attorney Kelly stated that she had not had the opportunity to review the <br />additional documents provided by the applicant prior to the meeting and stated that she would contact <br />Attorney Gottesfeld with any questions or concerns. <br /> <br />Public Heating - New Application -- David L.
