Louisville Local Licensing Authority - 2000 Annual Report <br /> <br />Member I~mmett moved to approve the annual report as presented. Vice Chairperson Lipton seconded the <br />motion. Roll Call Vote: Jeffers - yes, Lipton - yes, Kimmett - yes. All members were in favor, motion carried. <br /> <br />VII. POLICE DEPARTMENT'S REPORT <br /> <br />A. Incident at Bungalow Wine & Spirits <br /> <br />Sergeant Riggins reviewed for the Authority an incident that occurred at Bungalow Wine & Spirits on December <br />27, 2000. The incident involved a juvenile who attempted to purchase beer at the establishment and was <br />subsequently turned away by the employee, Chan Soo Lee. Sergeant Riggins stated this was a positive report that <br />he wanted to share with the Authority. <br /> <br />B. Incident at Gentleman Jim's <br /> <br />Sergeant Riggins reviewed an incident that occurred January 19, 2001 involving Gentleman Jim's Bar & Grill. <br />Riggins stated that the reporting officer, Joe Muldoon, is an instructor in alcohol recognition and is a drug <br />recognition expert. <br /> <br />Sergeant Riggins stated that, although there was probable cause for arrest, criminal charges were not filed. <br />Riggins stated that it was his opinion that this matter would be best addressed by the Local Licensing Authority. <br /> <br />Member Jeffers moved to order a Show Cause hearing for February 26, 2001 at 7:00 p.m., finding probable cause <br />to believe that Gentleman Jim's, Inc., d/b/a Gentleman Jim's Bar & Grill, 330 South McCaslin Blvd, Louisville, <br />committed one or more violations of the following State of Colorado Liquor Code, Colorado Liquor Code <br />Regulations, and/or City of Louisville ordinances: C.R.S. [12-47-901 (1)(a), stating in pertinent part that it is <br />unlawful for any person to sell, serve, give away, dispose of, exchange, or deliver or permit the sale, serving, <br />giving, or procuring of any alcoholic beverage to a visibly intoxicated person; C.R.S. [12-47-901 (5)(a)(I), stating <br />in pertinent part that it is unlawful for any person licensed to sell alcoholic beverages at retail to sell an alcoholic <br />beverage to a visibly intoxicated person; and Louisville Municipal Code [9.22.060, stating in pertinent part that <br />no person shall sell, serve, give away, dispose of, exchange or deliver, or permit the sale, serving, giving away or <br />procuring of, any malt, vinous or spirituous liquor to a visibly intoxicated person. Vice Chairperson Lipton <br />seconded the motion. Roll Call Vote: Kimmett - yes, Lipton - yes, Jeffers - yes. All members were in favor, <br />motion carried. <br /> <br />Member Jeffers moved to direct Attorney Kelly to appoint a Special Prosecutor to present evidence to the <br />Authority at the Show Cause hearing scheduled for February 26, 2001. Member Lipton seconded the motion. <br />Roll Call Vote: Jeffers - yes, Lipton - yes, Kimmett - yes. <br /> <br />Authority Attorney Kelly stated that it seemed to be beneficial to use a Prosecuting Attorney familiar with the <br />licensee and any previous violations.
