Corporate Report of Changes, the <br />Individual History Record for Daniel Waters, question 25 requires "from" and "to" dates of past residences. Mr. <br />Waters did not indicate the "to" dates. <br /> <br />Member Kimmett moved to approve the Consent Agenda contingent on receiving the required information <br />from White Lodging Services Corp. for the Manager change. Member Sackett seconded the motion. Roll Call <br />Vote: Sackett - yes, Koertje - yes, KAmmett - yes, Jeffers - yes, Myers - yes. All members were in favor, motion <br />carried. <br /> <br />VI. AUTHORITY BUSINESS <br /> <br />A0 <br /> <br />Findings of Fact, Conclusions of Law, and Final Decision and Order - Bungalow Wine & <br />Liquors, Inc., d/b/a Bungalow Wine & Spirits - Retail Liquor Store License - 645 S. Boulder <br />Road. <br /> <br />Attorney Kelly stated that a draft of the Decision and Order was contained in the member packets for their <br />review. Member Jeffers stated that there were a couple of items contained in the factual background and <br />findings that he did not feel needed to be included. He noted a sentence in Item G., which stated that "Mr. <br />Meagher testified at the hearing that while he was in Bungalow, he did not knock over any displays in the store, <br />fall down, or lose his credit card or wallet inside the store." Jeffers stated that he did not rely on this testimony <br />in making his determination. <br /> <br />Jeffers also noted two sentences in Item I., which stated that "During examination by the Licensee's attorney, <br />Officer Sundberg testified that the possibly could identify legally intoxicated persons more easily than a lay <br />person based upon his training, and that it may be possible for a legally intoxicated person to perform normal <br />activities for a short period of time" and that "Officer Sundberg testified that it is not possible for an intoxicated <br />person to change the appearance of their eyes." Jeffers stated that this testimony also played no part in <br />determining his decision. <br /> <br />Lastly, Jeffers questioned the accuracy of the second sentence in Item M., stating that Mr. Shin testified he <br />"helped Mr. Meagher select the gift set, and estimated the entire transaction with Mr. Meagher had taken <br />approximately one minute and forty-five seconds." Attorney Kelly revised the sentence to read "Mr. Shin <br />testified that Mr. Meagher was not loud, nor did he walk over to the beer cooler." Member Jeffers and Member <br />Sackett stated their recollection that Mr. Meagher did not pick out the gift set and that Mr. Meagher only walked <br />to the front counter of the store. Member Jeffers suggested that the sentence read, "Mr. Shin testified that Mr. <br />Meagher ~vas not loud, nor did he walk over to the cooler as usual. Mr. Shin helped select the gift set..."
